Have a tenant that's been at my property for 10 years. He wants new flooring. We are month to month. I have no problem getting new flooring, but don't want to be responsible to move his things (ie cost/liability). Wondering if legally I'm obligated with regards to expense moving furniture/household items. The property is in Georgia.

Have you asked him to please have things moved out of the way?

I would hate this. Once they’re in the units, I don’t want to interact with them until they send me a notice that theyre moving. (Besides emergencies obviously) I think this is where MYOB’s practice of cycling tenants out every few years in order to do update units makes a lot of sense. How much are you raising the rent for the new flooring? I’d want the cost back in 18-24 months. --24.152.xxx.xx

Thanks for the responses. I will raise the rent to have them paid off in 24 months which will put it close to market rates. They've been great tenants for 10 years. I also did tell him he would have to consider the logistics of potentially moving out for the day - iow - his items are on him. He didn't balk. If you are generous to provide new flooring while a tenant is in place, the tenant is responsible for any ancillary expenses such as moving furniture.

You are not obliged to do anything.... whatever you do for them is a gift. If tenant won't move stuff or refuses to pay for it to be done, then they get to keep the same flooring.

Like NE, I don't do any major renovations with a tenant in place. It takes longer and costs more to work around people in an occupied unit. --184.4.xx.xx

I once had new flooring installed at a tenant’s request. They were required to completely empty the house and live elsewhere for a week and their rent was adjusted accordingly. It was an unnecessary change out and was the only way I would agree to do it. --24.236.xx.xx

My mother has such request. She did the requested item to keep them renting from her. The next rent cycle they have their 30 day notice. Due to the new paint and flooring (on my mom's dime) they were able to receive their full deposit back! Image that! Had they just given notice to move the cost of the paint would have came out of their deposit and so would carpet cleaning. Oh well. I don't remember what happened next I suppose she was able to rerent at a higher price and recoup the cost going forward from another. --172.59.xxx.xxx

I had a driveway that kept getting washed out in the rain. I pushed it off as long as I could. Good tenant, long-term tenant, always on time with payments. The tenant kept asking for remedy. Finally, I have the excavator come down and grade the driveway out and dig the drainage ditch and pitch the water over to the ditch, etc. About 1500 bucks. Not only did I not get a thank you, which I don’t care, they moved about a month later. No way that I be putting flooring in this unit. --24.152.xxx.xx

I found your post.

Me? No to new flooring. Lots of people ask. It's very common. No harm in asking.

BUT YOU have to be strong. Managing means making the tough decisions.

THIS is where being the MANAGER, not the OWNER pays off. "Joe, Owner says not in the budget. Your rent would have to go up to cover the cost." Joe: "OK, just asking".

Then quickly shift the conversation to the paint he will be painting.

I agree, and have said no in other cases. This one allowed me to replace carpeting with tile while the unit was occupied and the tenants were paying rent.

I don’t do carpeting but the house was purchased with virtually new carpeting and there was no need to replace it just to replace it. After they were there for awhile they decided they would rather not have carpeting. Since I would be replacing it when they left I agreed to replace it while they were there so I lost no rent during the week it took and helped make the eventual turnover that much easier. --24.236.xx.xx

The national average on improvements and maintenance on a rental is 6% which sounds like a great deal - that is until you start putting on roofs, furnaces windows and floors.

I have a similar situation where I have someone who has been with me for 12 years and the place is in need of phase maintenance. I could slowly try to piece mill this job using anniversary incentive repairs, but the the fact is 12 years is a long time. She is 81 in good health and I would expect her to be with us 5-12 more years. So I am moving her into a different place I have picked up. Typically when I purchase a place I overhaul the whole thing, but this one got the new roof, power panel, and hot water tank. I kept the paint and carpet in place.

The place she is moving out of is a 4 BR and she doesn't need a 4 BR. I have owned it for 23 years so it is about time to peel that one off and find a new replacement. The new place is a ranch style 2 BR. If you are able to hook the tenant up to create a win win - you will also win. If you can't do that now, now is a great time to team up with another local investor. Referals are good as gold. --24.101.xxx.xxx
