It should be noted that pit bulls are BY A WIDE MARGIN more deadly than the second most dangerous, accounting for almost 70% of all fatalities. That doesn't mean other dogs can't be dangerous: it simply means that you should never accept a pit bull, even if the owner claims they are properly trained or socialized.

Note: People with pit bull ESAs/service animals have a special exemption for any landlord or insurance verbiage denying their type of dog. The good news is, you can still screen the person and the animal normally. If the specific animal itself has a history of attacking/biting, you can deny THAT specific animal, even though the breed itself is permitted.

To have an animal be considered in your rental application, you must include the following:

1. Photo and name of the animal.

2. Recent medical letterhead from a local vet which includes:

a) If your animal is spayed or neutered

b) Up to date on vaccinations

c) Breed type and weight

To have an animal be considered in your rental application as a support animal, you must include the following with your filled-out application:

1. A written request for a support animal as a reasonable accommodation.

2. Evidence from your healthcare provider of a disability and that you have a disability-related need for an assistance animal.

Misrepresentation of support animals is a Class 3 misdemeanor (N.C.G.S.A. § 168-4.5)

Any animal initially accepted will need an in-home visit to verify that they are friendly and social animals.

I don't think that there is any entire breed that is dangerous to the public. I can't take the dogs on my insurance company's list. I don't take dogs that are known to be diggers. I don't take puppies. I don't take any of the breeds that were bred to be man fighters. I don't take breeds that tend to be barkers.

All dogs must be interviewed so I can see the level of care, level of training, and the manners and temperament.

I prefer to take big dogs over tiny dogs, but the home inspection should tell if the little guys are piddlers or nippers.

There are dogs on my insurance company's list that I would take if I could. The insurance guys don't like them, so I can' take them. I would take a show bred AKC American Stafforshire terrier. You'll never meet a nicer dog than that. I'd take a British Staffordshire terrier, the small guys with the big heads. Although I can see an issue coming up with "why won't you take my pitbull when you accepted his". And it would be really rare to have a tenant who would pay that much for a dog, so I don't actually generally have them apply.

When people say it is not the breed, it's the owner it drives me crazy. Why does the AKC exist, why do people want "purebreds" (or NOT want purebreds!) Why do we even talk about wanting a particular breed of dog, like a Golden Retriever or an Australian Shepherd or a toy poodle?

It's because dogs (any animal species, really) are bred for certain breed characteristics and on balance, we expect the breed to have those characteristics.

To say breed doesn't matter is really ridiculous. And to say class of breeds doesn't matter is ridiculous. There are working dogs, sporting dogs, dogs bred for protection, aggressiveness or passiveness, looks alone, etc.

Buddy of mine shared two pages that he got from an applicant concerning their ESAs.

Both big pits. One named devil, can't remember the other.

Guy paid for online certification. Sent pictures of the dogs to get added to the paperwork. Big write up on each page about how the dogs were needed for emotional support. Obvious that it was a form letter and they just added the pic and the name.

Small potatoes... see if you can do a pet FEE instead. I don't know if that would be against the rules or not but it's worth a try.

Also... I'm not saying to do this but if you take the deposit and there aren't any issues (or even if there are and you take the money from it)... the tenant is going to be fine.

Most tenants don't even know the laws and WANT to pay extra just to be able to have their pets.

On a side note... my insurance company no longer has a list and my agent said "just require renters insurance and require that you are named first insured".

Something happens to the dog (or regarding the animal, etc) it goes against THEIR insurance first...

I don't know about all insurance companies but I would guess most, if not all, have to allow all breeds of ESAs and Service Animals. They were getting tied up in litigation because of it so now they get to exclude them from the prohibited list.

We do require the applicant to bring the support animal with them to the showing though. See if it is aggressive, barks too much as to disturb the neighbors, bites you, or maybe pee on the floor for you while they are there? No protections against animals that damage the housing or will push other residents out and create undue financial burden for you.

You can require that all applicants have and maintain renter's insurance.

Have accepted pets for years, with nonrefundable registration FEES and monthly additional FEE of between $25 and $40/month.

I require vet info, current vaccines, proper licensing, name and pic of animal, and a personal screening. If the animal does not like me, he doesn't get in. LOL

I need to add renter insurance required for those with pets.

My insurance co (SF) does not have a list of dangerous breeds.

My lease just says "no dangerous breed or bred animals".

It would be a better World without Dogs

As of January 2024 Illinois has a law that was passed in June of 2023 and went into effect in January of 2024 restricting insurance carriers from increasing premiums, non-renewing policies, or restricting policies based on specific breeds of dogs for Homeowners and Renters Policies.
