My tenant brought a dog to my rental house. As action to avoid extra pet rent and additional security deposit give me a letter from doctor that need Emotion Support Animal.

Should I just accept new situation or request deposit and pet rent? --136.226.xx.xxx

I would verify that the letter is legitimate. I contacted the medical professional to verify that he did in fact generate the letter and sign it. Sometimes a well meaning receptionist might do a favor for a patient. --146.70.xxx.xx

You may have to just accept it. In my state I would not be able to collect a pet Fee (not deposit) or deposit (refundable) or pet rent. There is plenty written on this subject. Just the search feature above and educated yourself. Hopefully someone from your state will come along with specific information. --172.59.xxx.xxx

Next !

If there's any changes to be made,

that's the direction I'm gonna go.

I took the high road and never rented dog houses to dogs,

and still made a fortune with a lot less stress and headache. --69.130.xxx.xxx

There is a lot of info here on this topic, use the search option and pay attention to the responses from your state, there is only 1 question you are allowed to ask about these animals that separates the fakes from the legitimate patient doctor relationships. --184.59.xxx.xx

By law you can not charge pet deposit or pet rent for an ESA. However if the ESA/owner doesn’t follow any rules you have for animals/pets like picking up after them, disrupting quiet enjoyment, damage, etc then you have some recourse. --73.159.xxx.xx

I don't know what is in your rental agreement, but mine (used to) says that any animal must complete (OK, it's owner) an application and be approved before moving in - just like a human resident.

So, I would have sent them notice of such - they mixed up the order of things.

However,

I now do "Animal Inclusive" rentals. Extra deposit and higher rent already built in, for up to two Approved animals.

If they add an animal after moving in, the animal still needs to apply & be approved first --68.229.xxx.xxx

If it is a legitimate Dr. note- It is FEDERAL that you have to accept, can not charge pet rent, or charge pet deposit.

Tread carefully.

What you are allowed to do is to check if there are any damages from the animal -- and charge for those right away. (every 3-6 months check up) If the animal is creating an ongoing problem-- the animal and or the tenant can be evicted. --76.138.xxx.xxx

Just curious, does an ESA need vet records and be on as added insurance? --73.230.xxx.xx

pet (by John... [MI]) Posted on: Apr 11, 2024 9:06 AM
Message:

MC: You can require those things if they are required by some other ordinance for all animals. For example, if your county requires that all animals are vaccinated, then you can require it of an ESA. However, if that is NOT the case, then you likely cannot require it of an ESA.

Ask for vet records then. Being an ESA, can you require pet insurance or is there separate ESA insurance in case of a bite/incident? --73.230.xxx.xx
