Does anyone have the good verbiage for 30-Day Change to Agreement that, should there be the need to termite tent, the tenant is responsible to find & pay for their own temporary housing?

Are there some good ways to say it? ... I am thinking I might forget points to add!

Laker - When I get ready to make a post on this site I almost always go to MS Word and type the post, copy it and then move it to Mr. LL site.

Why. Because I can not read, write, spell very well. MS Word does a lot of that for me.

Back in the day when I was in school (over 80 years ago) if they had special Ed classes I would have been in them my total time in school.

You ask about a change of agreement. Are you wanting to CHANGE your rental contract agreement or do you want to get rid of the tenants, as in - Have them leave?

Next you ask about termite tenant. I am guessing you mean terminate (to get rid of) tenant. Have them move out.

Then you ask if it is the tenants responsible to find and pay for their own TEMPORARY housing. Are you going to let the tenants move back into your property.

I know nothing about having to find TEMPORARY housing for a tenant you are wanting to get rid of or even paying for their housing. Maybe California has that rule but Missouri sure doesn’t.

Below is a little short termination notice I gave to tenants.

Hope it gives you ideas. Change it to make it fit California rules and requirements.

NOTICE TO TERMINATE MONTH-TO-MONTH LEASE

DATE: 26 March 2024 Date I select. Remember, for a M2M contract I must give at least a 30 day notice and it must include a full rental period. One month.

PREMISES: Address of property.

TENANT: Names of all tenants and all others

LANDLORD: My name

LANDLORDS MAILING ADDRESS: My mailing address.

This letter serves as legal notice that as TENANT(s) of the above-described PREMISES, you are hereby notified that LANDLORD has elected to terminate your tenancy of the PREMISES. You have until April 30, 2024 (giving you at least a 30 day notice) and at that time LANDLORD demands that you remove all tenants from the PREMISES and surrender peaceful possession of the PREMISES to LANDLORD by said above termination date (4-30-2024).

A walk-through move-out inspection will be conducted at 1PM on termination date stated above (or sooner if a written request is given to landlord by tenant). Tenants are welcome and are encouraged to attend this walk-through move-out inspection.

You are hereby notified that acceptance by LANDLORD of any future rent payments or other lease performance by TENANT shall not constitute a waiver or withdrawal of this notice and that if you do not vacate by said termination date, LANDLORD intends to take legal action against you for recovery of possession of the PREMISES, double damages (twice the fair rental value) for each day you remain in the PREMISES after said termination date, and other applicable legal remedies.

Tenant Signature ________________________________

Landlord signature ___________________________

One tenant signature constitutes acceptance by all tenants.

I read it that she may have to tent the house to treat for termites and wants to know if there is a document the tenant could sign to agree to pay for their own temporary housing while the house is being treated.

I don’t have such a document and probably wouldn’t have any tenants that would agree to pay for temporary housing during termite extermination. --68.186.xx.xxx

Too many unknown. Why not just end the agreement? If whatever the issue is doesn't fix itself in X time, you don't have to extend. If it does, start a new lease. If it isn't habitable, that ends it ASAP. I would think that would include CA, but I wouldn't know. --73.230.xxx.xx

You are in California. You may have to pay for their housing until they die and their unborn children also. California has so weird laws. If I was a homeowner with such house wouldn't I just love there while it's being treated? Again your state laws prevail. While I consider bugs to generally be a tenant problem, termites are a landlord problem. Nothing the tenant has done has caused them or can get rid of them. It is not something normal to deal with like house flies. If it is not dealt with, it destroys the house.

For me, if I have to tent, I offer to put he tenant into a mid range motel for the day or so that it takes to get the job done. Normally, tenting is not along process. --76.178.xxx.xxx

We don't have to tent in this area. Different bugs and rules. But if the place was uninhabitable for a day or two because of no fault of the tenant I would think the best solution is put them in a decent motel for a couple days.

Can they tent, fog and clear out the house in a couple days?

If the termites have been at it for a long while and there is severe damage to the property I would think that you should let them out of the lease so you can repair said damages. --107.147.xx.xx

Why do you need to use a tent? Around here, baits are far more effective than traditional poisons because baits kill the entire colony. Poisons just kill the foragers. And baits create no inconvenience to the tenants. --107.141.xx.xxx

Lori,

Leaving the home for maintenance or disruptions by nature are an everyday part of LLing and are spelled out in a proper lease.

My lease is clear: Management does not provide alternate housing.

Now in real life, each time we've had power outages or such the renters had friends or family for temporary housing. One said "Wonderful! I'll use my points for a mini vacation at the hotel with a pool!"

Google tells me tent treatment is 24-72 hours. $100 for an overnight might be good PR and make you feel better.

Termite inspections are inexpensive. Cal around for quotes. Terminex was 4 times!! higher than the local guy.
