Hello everyone and Happy Easter!!!
Long time i haven't been around here. I have a question, if the tenant due date is the 1st of each month, the notice of non renewal letter should be provided by the last day of the previous month, for example, today March 31st? Or by the 1st?
And should i give any reason? No lease with these tenant's they are month to month. They are not bad tenants but i need to allocate some family and do some works around the place, that i know current tenants will give push back as they had done before when done major updates.

Not sure in MA but in NY it's considered 30 day (calendar month) so you would have to give them written notice by today.
I'm sure this isn't a "sudden" move on your part... why are you waiting until "today" to advise them? I would have given them a bit more notice (personally) so they have ample time to find a suitable place. Maybe that's just me.
Plus, in NY... we have to give them notice 30, 60 or 90 days prior depending on their length of residency there (1 year, 2 year, 3+ years) ... I don't know what MA is but I think they are pretty much tenant friendly too... from what I've heard on here. --69.201.xx.xxx |

Hi Johnny, i just wanted to confirm, i was planning to do it next month, thanks for your input. I am planning to give them 2 month, know they can take up to 3, my idea is that they could be out by summer.
MA for M2M is only 30 days, no matter their length of residency.

Whenever I'm either terminating or changes the terms of a tenancy, I normally give 60 days or 2 months (whichever is longer) written notice. The only time I don't do this is when I give 14 day nonpayment notices or 7 or 30 days notice to cure a rental agreement violation. IMO you are wise not to give a reason for the termination. If they press you on your reason just say that you have other plans for the space. --96.233.xxx.xx |

LZ, if you decide to just give them 30 days notice it has to be done 30 days or one month before the due date of the next rent payment, whichever is longer. You can find a lot more info here;

Yes i am willing to give them 2 or even 3 month if needed, thanks God is not due to non payment nor late payment neither due to rental agreement violation.
Just wanted to confirm i am not required to disclose the reason.

Do not give a reason or they WILL argue with you. Simply give them notice with a specific move-out date. Even if you have flexibility on that date, DON'T TELL THEM! That way if they DO need a little extra time, you become the hero by accomodating the request. --104.230.xxx.xxx |
