So one of the inquirers is a woman with two kids and who lives with a SO. Apparently the father of her kids. I do plan to DQ them for other reasons, as I spoke with the attorney who presented at the local LL meeting last night.

He actually said that if the SO (in this case level 3) has a "perimeter" of how close he can be to schools (my unit is right on top of the high/middle school--about a 3 minute walk) and I deny him anywhere outside of that perimeter, I can be in violation of his Fair Housing/Civil rights!!!! He told me it's best to DQ them on something else and not the SO charge.

The SO seemed to poo poo the charge and so did the female inquirer. "That was 15 years ago--all behind me now."

Yet if you look up his name it pops right up on a SO map showing where they are currently liiving. Apparently the owner is "selling and wants them out so she can sell" ™ --64.246.xxx.xxx

Sid, I can deny them on his credit score (below 600) I usually just ghost them. If it's someone that qualifies on the prequal, they'll hear from me right away.

In other news, the squatter I saw in eviction court completely lied on the prequal, said her CS was over 600 and that she's never been asked to move. LOL --64.246.xxx.xxx

I'm puzzled--you can deny him inside the perimeter based on his criminal background but not outside?

Is SO a protected class in your area? I know NY is clamping down on criminal screening.

In my town there is no place 1000' (or is it 1500') away from a school, daycare, church, etc. SOs must live out of the city.

Little in home daycares are everywhere.

I just wanted to clarify something about NY law (that might not be obvious)...

NY's Sexual Offender Act does NOT restrict where a registered sex offender may live in relation to a school. That is the case only of they are still under parole or probation. If it has been 15+ years for this guy, he probably isn't under parole or probation any longer.

So, I'd definitely keep the "school perimeter" stuff out of any decision making.

I have one guy who did not qualify for a rental property of mine due to being on a sex offender list for kidnapping his own kids from his crazy ex-wife. Dad did what he had to do, It is what it is. NE, I well know about crazy Ex wives. My DH has one. She worked for CPS as a caseworker and used her influence to make false abuse allegations against him so that he was immediately put on the NYS Child Abuse and Maltreatment Registry.

We didn't get the chance to refute this report b/c due to a "clerical error" ™ the paperwork to dispute it never came in the mail (yeah right). His ex is a big wig and practically the mayor of their town, population 5K.

She ran it straight up the flag pole and it took me a year of contacting politicians, attorneys, etc. with the evidence to get it overturned. It eventually went to "unfounded" due to all our evidence that she was lying and influenced his older two to lie. Of course, that completely enraged her so she cut off all contact to his kids (3). Aka Parental Alienation. It continues to this day despite all three now in their twenties. --64.246.xxx.xxx
