So I'm wonder if I could be in trouble from a PITA tenant that I want out

After being there for a few years she applied for section 8 because she said she couldn't ' pay anymore...we allowed it. After she was on the program for about a year she became more and more of a problem.

So much so that she yelled at my handyman, and then my contractor's men when they went in to attend to minor problem that all said they would not go to the unit again . She yelled that "I pay rent!!" ( Personally about 80 dollars of a 1200 apt with heat) she also yelled that the contractor hired "stupid Puerto Ricans" and a number of much more racist things that won;t mention here. (one of the men is a tough Marine who said he was so affected dealing with her that he went home shaking.)

So I really want to be rid of her, and I raised her rent,..it was a bit beyond the section 8 payment and now her contribution is about 220 and she is enraged

and wants new wallpaper, all other walls and woodwork painted,.

The service guys have mentioned she has an illegal cat and claims that a

daughter that we find has moved out some time ago which no longer makes her eligible for this big 3 bedroom unit.

So my question: since I only raised her rent two months ago and so much of this more recent and severe conflicts,..would you think I can raise it again more substantially without her making some type of claim that she is being retaliated against.

I'm guessing she will stop paying rent and getting a free lawyer that might argue that in eviction court .

Same if I try to not renew her sect 8 contract.

Any advice how you might act?

I can only raise by section 8 rents once a year. Your area is forsure different. I would read my section 8 contract and exit according to the rules I agreed when signed. No such thing as an illegal cat, but if animals are prohibited then just evict her / non-renew her lease for violating the "no pets" clause of your lease.

Yes, most likely. MA has long been known to be a tenant-friendly, leftist state that jerks landlords around. This should not come as a surprise.

Contact a landlords association where Google to find or go into this website go find. Next minimum standards under building code is not cosmetic where colour does not have to match or floor tiles do not have to match where no lose paint, plaster or unpainted surfaces. A touch up is only required. No loose or missing tiles where again does not have to match. Go into town or city get a copy of building codes. Where everything has a number relating to building codes. Locks have to work, heating system has to work along with plumbing has to work, no leaks from outside, receptacles and light switch covers must be covered. So as long there are absolutely no building or fire code violations than one percent on and off where can bring rental to market with some renovations than avoid government altogether. Keep records of all repairs and invoices to show rental unit is maintained. If they refuse entry for repairs than record as well. --207.236.xxx.xxx

Is she MTM? If she is, terminate her lease and file for possession if she doesn’t move. No reason needs to be given. You’ve had her for a year on Section 8 so it would be hard for her to claim retaliation. Bolster your case to get possession in case she doesn’t leave though. Send a NTQ now for her behavior towards the contractor.Then terminate tenancy. After you have sent sheriff to serve notice to terminate tenancy, only then do you send NTQ for the cat. We all know it’s going to magically turn into an ESA. It won’t matter if you have already had her served by sheriff. --68.191.xx.xx

In my state a section 8 person does not want an eviction filed against them cause the will loose their voucher..so the will just move before that happens. Oh and if I file, section 8 will also stop paying me. So tread carefully but know the rules of the process. --172.59.xxx.xxx

After out then consider converting out electricity, heat to where tenants pay and control use. This is expensive upfront where immediately increases value of building along with screens out problem tenants who have unpaid utilities.Major renovations will paid for by higher rent. Most governments want rental units all inclusive where the better option is stay clear of government programs all together. Past experience with governments is tenants feel they should not portion of rent by them even though that is $135 per month. Most of them do not work where social assistance. It is better to get someone who works less drama and issues as they know how hard it is to work. As long as governments fail to implement work fare these people will continue to be spoon fed along with visiting the food banks then throw away a lot of food as they are picky. People who work live a normal life along less likely to use illegal drugs. One thing to consider when renovating is not to use residential flooring like carpet, laminate flooring or wood flooring in a rental unit where it is better while more expensive upfront along much more labour intensive to install Schluter Ditra membrane then install commercial porcelain flooring which is easily cleaned up with a mop with bleach.. A lit cigarette does not burn. Commercial porcelain easily lasts ten years even more where once they move a quick mopping then ready to rent. Tenants will often sneak in a pet where if a vicious dog then can take action. Here I see rental housing providers use landfill type of flooring where every 3 years replacing all over again. C) Be a good neighbor: Tenant shall not commit any waste upon said premises, or any nuisance or act which may disturb the quiet enjoyment of any neighbors. Neighborhood complaints of noise, trash, unkempt yard, improper parking, unruly behavior of an occupant, unruly animals, noisy visitors, arguing, yelling, multiple police calls, are grounds for termination of tenancy. When I had a tenant playing these games, ( not nearly as bad though) I went back to the Rental Property Association group in my area, and attended their bootcamp. A lot of my questions were answered during the bootcamp training. It takes a bit of schedule juggling for me to attend the monthly meetings, but, has been worth it. Especially to just hear other stories of how people handled these things in my area. I had let my membership lapse due to the schedule conflict.

My tenant still isn't out, but has been performing better. I feel more confident about the actions I have taken because of the bootcamp.

As your tenant is on Section 8 assistance, does anyone know if the Section 8 office will offer any assistance ? Harassing the repair crew is pretty ugly behavior, in my opinion. If Section 8 knew she is being vile to the tradesperson, causing them to refuse to do work, might they pull her assistance? I haven't had anyone on Section 8, just wondering. --72.135.xxx.xx

No, you don't have to give her new wallpaper and paint unless those things failed the most recent S-8 inspection.

After the initial lease term, the frequency of rent increases is determined by the local housing authority. Mine says no more than once per year. Don't try another rent increase until you consult with her caseworker.

Be careful with your S-8 increases. Rent for a S-8 property cannot exceed what you charge for similar units that you own or manage. --107.141.xx.xxx

Sid has good advice.

Treat S8 just like you would any other tenant- except that you send a copy of violation notice, notice of termination etc to the housing. They need a copy or it didn't happen ( as far as they are concerned)

I have gotten rid of a couple of bad S8 tenants-served "for cause" eviction notice with copies sent to housing. Just make sure you follow the law.

Document, document, document...just in case.

I have one good S8 and one great S8 tenant right now. They are not all bad.
