I have rented to this Tenant twice in the last 5 years. I have asked her recently approx 3 weeks ago, to find another apt to call home. Why? because of a relative that is violent with her and causes a disruption for not only her but the entire building.

The situation now has intensified as her dementia is getting very bad. I’m not sure what to do here?

Do I call elder care? She is texting me some very odd off-the-wall stuff.

Honestly, I don’t think her family knows what to do at all

She has recently retired. In the past, she was the one who lead the family in the right direction. She came up with solutions and the funds to make them happen. Unfortunately, now she’s having a very hard time keeping her mind straight. Hard to see her mind so clouded

No she does not have an emergency contact. She lists her granddaughter. The grandaughters solution is she stays with me and I handle this problem. No can do. Not my place to take on this task. My biggest issue is getting her problem relative never to enter my building again. For some dumb reason the police will not give me a restraining order? Yet they did give one to the tenant good until 2030. In her dementia/Alzheimer’s state, she allows the person in and hides them in her bathroom from the police. This person actually bites people. I need a solution like yesterday. I am staying calm. But very alert. I want this over rover. Yippee kye-Yeah. --71.9.xxx.xx

It sounds like you are reacting emotionally, rather than logically. That is understandable, because you are a caring human.

BUT:

You have a business relationship with this woman through a contract for the parties to perform certain actions.

You must abide by that contract. That means giving notice for improper behavior by her or her guest, and following whatever procedure you would for any resident who did or allowed those things that break the contract.

It is not for you to decide whether or not she "knowingly" alllowed something or not. If her rent is paid, and other parts of the contract are being upheld by her, then continue as usual until they are not. Do not try to evaluate her mental (or other) health, as her landlord. It's not part of your responsibility in your contractual relationship.

Keep a certain emotional distance and conduct your business in a factual, business-like manner.

Now separately - not as her landlord - you may also choose to support a non-profit group that cares for the elderly or anything else. Including being a concerned neighbor who calls police/senior services to check on her welfare or whatever.

Get paperwork started. Send to resident and CC the granddaughter. Post on the door. Read your lease and nail them for every violation you can according to your state law. It may sound curial but once you start enforcing what you can things will change. Resident will either move or get help or both. It could be a simple change of medication but until there is a reason everyone will stand around pointing fingers. This is how you start the process of solutions. Be the change. --172.59.xxx.xx

I had already given her the correct paperwork.

I resolved it today. Doing some fascia replacement and gutter install. I am taking a coffee break sitting on the stairs.

She to me. Starting to get cold out here. I nod my head yup sure is. Makes this coffee even better.

She asks: What room number are you in. I laugh. All of them I own the joint. Oh I didn’t recognize you! Did you get the two texts I sent you last night? Yup. Did you respond? Nope. Are you going to respond? Nope. So I can’t stay one more month? Nope! Oh, oh my. I wait a bit. Build the urgency I cannot, and I will not tolerate your grandson being here at this property any longer as I said in the document, I have a responsibility to all tenants that call this building their home. I respect that I respect them and this is my final decision. I will not waiver. Her response. Oh, oh my! I finished my coffee, then went back to work. --71.9.xxx.xx

Depending on how far along her dementia is she may not remember the conversation or the texts unfortunately.

Sad times for sure, but you did the right thing. Stick to it and get ahead of the pending doom that will be her life.

You don't need a restraining order. There is a new law that Newsome signed that went into effect in January. Here's an excerpt from an article on it.

SB602(Penal Code Section 602), property owners who have problems with trespassers can submit a no trespass letter, commonly referred to as a 602 letter, to local law enforcement. These letters, once filed, remain in effect for 30 days, giving law enforcement the mandate to remove trespassers from the designated property. --209.205.xxx.xx

From a 10,000 ft look - you have a tenant that is dangerous and you are wondering what to do. Should dangerous people live in your building with others who might also be in danger?

I really hope this place isn't in Callie. If you are asking is it possible for you to get sued for allowing this condition to exist without acting in a manner that minimizes the danger, in one of the states where so many lawsuits get filed. --24.101.xxx.xxx
