Because Iowa can not make up their mind on anything....

When does the 3 day start when you are doing a 3 Day Notice to Quit for Clear and Present Danger?

Regular mail, certified mail and door posted yesterday by 4:55pm. Sheriff served this morning at 9:41.

Does three day start today? Or yesterday?

Help.... TIA!

A day is 24 hours long. Add 72 hours to whatever date/time the thing that relies on time occurred and then 3 days have elapsed.

If the law say you have to give notice by all four methods (reg mail, cert mail, door post and sheriff), then whichever one happened most recently is when the clock starts ticking because the requirements of the law were not fully met until that time.

If the law says you have to give notice using any one or more of the four methods, then whichever method happened first is when the clock starts ticking, because that is when the requirements of the law were fully met.

Or you could just be safe and wait 4 days to avoid wrangling over definitions in court.

Thanks Sid.... such "clear as mud" as the Cler5k of Court told me.... LOL

I'd like to be able to file asap...knowing that this person is going to destroy the unit, is my fear. And our Judge here in town is not the nicest when it comes to Landlords. She tends to side with the tenants, even if the proof is right in front of her.

OH has a 3day which begins when posted, weekends and holidays are not counted in the 3 days. post Thursday before good Friday and you can not file until Monday following easter. --184.59.xxx.xx

My court goes by DATE. 5pm on Monday is Day One. And we post on the day it's typed.

Mail would be 3-4 days later.

What is the clear and present danger to your property?

We have a judge in town that makes her own rules.... so I am wanting to make sure all my basis are covered.

This gentleman found the property manager at Wal-Mart when she was off the clock doing personal shopping and was demanding a copy of his lease RIGHT then and then started yelling threats at her and pushed her cart into her - took 3 cops and 12 Wal-Mart employees to get him away from her and that was after multiple verbal threats... so we mailed (reg and certified) posted door and had the sheriff serve him a 3 Day to Quit for Clear and Present Danger.

Ticking time bomb and we do not want him to continue living in our unit.

Sticks it sounds like you have your priorities in order. Where it is absolutely awesome when you get paid the money owed (and in Pa that is largely dependent on how the notice was served.), the amount that is owed to you pales to how much damage an upset tenant can cause.
