I have a man who wants to rent my rental house for his mother. He won't live there, but he takes care of paying the rent. What do I call him? I don't want a co-signer situation. Are there laws set up to regulate this?

I had a similar situation where the parents wanted to rent a house for their unmarried daughter w/ infant. Financially they were well-qualified.

I assume I would need a different rental agreement, where the absentee lease-holder is responsible for the occupants behavior?

I would just lease it to the son and his mother jointly and severally being responsible for all these payments. If the sun credit wise qualifies there is no problem. --23.162.xx.xx

I would put them both on the lease,doing it any other way makes it easy for a judge to take the son off the lawsuit when you have to evict or sue for damages and back rent --74.77.xx.xx

I agree. If they both are qualified, make them both tenants - with the same rights and responsibilities.

That way, if any part of the lease is broken, they are both liable. Also, if mom's health gets worse & he wants to stay there to help her, it's already approved. (that might help him to accept it better if he starts to balk) --68.229.xxx.xxx

I agree you want both on the lease jointly and severally. I had a tenant once with some developmental challenges. One brother was on the lease as jointly and severally so I could call him if there were any concerns or issues. Another family member handled all the finances and was called the representative payee. I notated on the lease that I had permission to contact the representative payee. --73.159.xxx.xx

I think that is best in Tennessee, red state, where I am, anyway (out of range of URLTA). Naming somebody on the rental agreement gives them rights. In TN, if I prepare a month-to-month agreement properly, and if the tenant has not paid by the 10th of the month, I can have the sheriff there in as little as 14 days. With last month's rent pre-paid, I lose only the filing fee, service fee, and the cost of having the sheriff come out if it comes to that.

Financially it makes far more sense for Son to buy a house for Mom. So, my conclusion is that I will not accept this type of situation.
