I have a 12 month lease ending 30th November and I pay rent on 1st.of each month. Landlord sent me a written notice telling me I must vacate by 11th November and gave no reason. I am not in violation of any terms of my lease and I have always paid my rent on time. I really want to leave on October 31st instead of 11th November and not pay 11 days rent for November. What are my legal rights in this case. Should I get my security back? Thanks. --24.126.x.x

There does not appear to be a "Landlord Violation" as you labeled this post - based on the information you have given.

This is before Oct 1st, therefore you have been given more than two full rental-period's notice that your lease will not be renewed - and you have possession until Nov 30th. I don't know why they would say the 11th. Check in a friendly way to make sure that wasn't an innocent typo.

Keep in mind, I'm in VA, not MD. You need to read your lease. Typically, only one rental-period is the required notice, but it varies from state to state.

You need to read the MD landlord-tenant laws, regarding proper notice from either party - and anything else you have questions about. The law will also tell you what your rights are. Know the law before you get steamy under the collar and do something wrong.

Generally, though:

You have the right, as a competent adult, to enter into a legal contract.

From what you said, both parties have abided by that contract.

You have said the contract has an end date - Oct 31, 2023. It does not extend into infinity. This is how it works when you rent something - whether it be a house or a car or a canoe at the park. When the agreed-upon rental period is over, you must return it to the owner - unless both parties negotiate and come to an agreement to extend or create a new rental contract.

If either party does not want to continue renting that item, then no new contract is formed, and each party goes happily on their way. No reason is needed.

You do not have the right to keep the canoe, car, or house longer than agreed upon. If you do, there are consequences. You will continue to be charged for the canoe for as long as you use it and will need to pay a much bigger fee when you finally end your lovely, relaxing day on the water.

If you keep the car too long, there is a clause in that rental agreement that you will pay for that extra time - and at some point the car will be reported stolen.

If you stay in a rental house beyond the terms of the lease, your landlord will file for eviction for hold-over. Meanwhile, you will have to pay hold-over rent (much higher rate), your previously good rental history and your credit & criminal records will be trashed. Yes, staying in a house when you have no legal right to is a crime, (just like if you stole the car)and an eviction is on your criminal record. If you want to rent another "nice, well-managed" place, where the landlord checks these things, you won't be allowed to.

Regarding the security deposit: That is to guarantee that the property will be returned in the same condition as it was in when you received it. If it is not in the same condition, this money is used to either cover the cost or off-set the cost to return it to that condition. If the deposit is not enough, you will need to pay the difference. If the deposit is more than what is needed (ideally, there is no need for anything to be done after you leave) you are refunded that money. Check MD law again - for timeframes, interest on unpaid balances, etc.

With all this is mind, I highly recommend that you: Pay October and November rent on time. Quickly act to secure another place to live. Remove everything from the property that was not there when you moved in. Clean it at least as good as it was when you moved in (don't forget under the stove & fridge & tops of the ceiling fan blades, door frames, tub surround, etc - every detail). Scrub it until it shines. Make sure everything is also in good working order, as when you moved in (even lightbulbs). If anything is loose, drippy, broken or missing - take care of it now. If it is something the landlord would fix, report it now - and allow the repair people in to take care of it before you move.

If you think you can find another place in one month rather than two:

Again, read your lease. What if anything does it say about leaving early? If there is a fee to allow you to legally end the contract early, it is probably more than the last month's rent. You may approach the landlord, in a reasonable & friendly way, and see if you can negotiate terms to leave earlier. If no agreement is reached, continue to abide by the lease contract.

If you leave early and do not pay November rent as required, then the landlord will file for eviction for non-payment (yes, even if you are gone - the contract is still in force until its end date) and this will trigger all the negative things listed above.

If you have the lease ending November 30 then he can't tell you to leave Nov. 11. Send him a certified letter telling him he can get the place back on November 11 by refunding October's rent and giving you that and your security deposit and you will meet him at the door with his keys as he hands you those two checks. I am not an expert on Maryland law.

In Pa I tell my tenants, that if they commit murder that our governor can get that removed from your records if you follow the correct steps. However if an eviction is filed on you and ruled against you, in Pa it never comes off your record.

That report can impact your future ability to rent, the hiring process potentially on your next job and may result on a judgement that would also follow you around. These are all a result of YOUR behavior.

Do you really want all these headaches?

You are at a cross roads. If you want to go and the landlord agrees to let you go, even early - you might be wise to learn from your experience.

I am assuming that you have an issue of some kind with your current landlord or you wouldn't want to leave early. Sometimes its best to agree that the two parties disagree and move on in a respectful manner.

You are correct. If the tenant has a lease until 11/30, you should be able to stay until 11/30. For what every reason, if you think it is worth possibly ruining current and future rental opportunities over those extra 19 days, challenge your landlord.

You will probably win in court. I can tell you though, I would view someone who did that during the future screening process in a manner where you simply would NEVER EVER Qualify. Things worth checking:

1. You say you have lease ending November 30. So on what basis does landlord demand you leave earlier?

2. You should be able to ignore Landlord notice to leave November 11, having a right to stay until November 30.

I would write a letter to landlord, demanding to know, by what right does he demand that you leave before termination of the lease, and that since his notice is defective, you will be staying until November 30. Does that help you about leaving at end-of-month? Why do you want to stay only until October?

3. You might find it useful to check if MD allows terminations on any day of the month. It might strengthen you hand.

4. It never hurts to talk to the landlord, to find out what he really needs. Maybe you can make a satisfactory compromise.

After that, your landlord does not have to give you any reason to ask you to leave, this is simply called a non-renewal. Talk to your landlord about why you can't stay until the end of November. Do NOT demand as Moshe suggests. Whether your landlord is following the law or not, being demanding will get you nowhere. Stay professional, reread your lease end date and make sure it says 11/30. If so ask since your landlord is stating you need to be out by 11/11 instead of 11/30 as stated in the lease, would the landlord agree to a 10/31 move out date ending the lease 1 month early. The tenancy has come to end so can pay rent per diem 11 days than move out where now have to focus on getting another rental unit or house. A lot of rental housing providers here are selling houses, townhouses and condominiums which are becoming owner occupied then the secondary rental housing is declining. To calculate per diem multiply times 12 than divide by 365 then multiply the number of days. Had tenants move out in the middle of month where someone moved in then the tenant wanted rent for the whole month where only charged the new tenant per diem not the whole month. Here rent is really expensive along with vacancy rates are really low. --74.220.xxx.xxx

Why do you care if you should be *allowed* to stay until November 30?

You want to leave early - October 31. They want you to leave early - November 11. Contact your landlord and work it out. The issue is payment for those 11 days.

Your security deposit is an entirely separate issue but I would confirm from landlord in writing that any early termination won't affect security from that stand point. Security to be used only for damages, not rent. --98.237.xxx.xx
