Legal age to sign a contract is 18 unless they are emancipated. Likely, they don't have past landlord history which could exclude them depending on your requirements. --50.26.xx.xxx

My apartment manager rented a unit to a 17 year old. She never paid the second months rent and I won my eviction but couldn't enforce the contract with rent and or damages. No legally held to a contract until 18 years of age. --47.156.xx.xx

There must be countess reasons to deny. 1 year positive landlord reference, 1 year at job, qualified co-signer, good credit history, no criminal (wouldn’t show up... juvenile record), garnishable income, etc. I can’t imagine that 2 17 year olds on welfare out on their own are squeaky clean. --24.61.xxx.xx

They cannot enter a legal contract at 17. I doubt they are emancipated, that is likely pretty rare. If they were emancipated, they would have court paperwork to show you.

since NY now says you can't discriminate on income, wouldn't having garnishable income be a violation?

Ken saying you can't enter a contract with them sounds legit. I have had a lot of youngin's recently. With no rental history I say deposit is doubled at a minimum and might there be a parent to cosign/ guarantee the rent. So far crickets is the response. Next!

So even if they have DSS, DSS won't double the amount they pay.

David if they have custody-- you must see court order granting it. We've had some lately say I've taken in my relatives kids --- no naw negative. If you have custody lets see the court order--- its just another way to get 5 family's into a SFH.

OP how did you take an app from someone not old enough to sign a contract? Did you forget your Lease is a contract? First line on the app says DOB? --99.103.xxx.xxx

I don't believe you can legally sign a contract under 18 years old. I'm a bit surprised that they will be able to get any assistance too - I'd question that (but only to try to figure out what's going on because I'm inquisitive - in this situation I probably would just say "no" unless they "press the issue" and then I'd want to see the paperwork from DSS - or wherever they are getting the funding from.
