State Specific Question About: OHIO (OH)

Former tenants mailed cashier checks to me. I was unable to cash 3 checks because I was out of country. When I sent them to a friend in Oh to cash, they needed to be reissued because of date. Tenant met my friend at bank and told bank to reissue to him. The last cashier check had stop pay issued on it. I searched reasons cashier check could be stopped. They said it could be reported lost or stolen and stopped. These tenants have been evicted. They filed chapter 7 bankruptcy in October. Bk dismissed in February. How can I collect on these checks. The last cashier check was clearly fraud. --165.227.xxx.xxx

Should have had friend immediately deposit them in your bank. Since they're filing bankruptcy, and their credit is about to be trashed, they probably included your debt in the bankruptcy and then cancelled the cashier's checks. Wonder if dates of BK and stop order near each other. Wonder if they waited to near expiration of cashier's check to mail it and timed it with your vacation.

Not the best source for this, but short of suing, I don't know how you could. If the checks were cancelled, the money's probably been returned to their account. In that case, the bank isn't going to withdraw money from their account without permission. I'm thinking you have to go to them for the money but they have the bankruptcy on their side. Might want to talk to BK lawyer. Wonder if it best to wait before pursuing, or if even possible if you're listed on the BK. --108.69.xxx.xxx

In hindsight, everyone should know that you can deposit checks (but maybe not cash) to someone else's bank account. Do not have to show ID. --144.250.xx.xx

I provide some of my tenants with "Special" bank deposit slips. It allows tenants to deposit their rent check in my account without a special enforcement on the reverse of the checks. Each of my banks has a different procedures on non-account holder deposits. Ask your bank first before you allow tenants to make deposits.

One back would only allow these deposits put into a "deposit box" located in the bank and not a teller deposit. --47.156.xx.xx

You said the BK was dismissed. If that's the correct word, then you can still collect (legally). If you mistated that and the BK was DISCHARGED, then you can not collect on any debts from before the file date.

Now any debts from AFTER they filed, are fair game.

Example: As of 1/1/19, they owed $2000. They filed BK on 1/15/19. If the BK does get discharged, then you're out the $2k. If it is dismissed, they still owe it. If they're still there on 2/1/19, they still owe you Feb rent regardless of whether or not the BK gets discharged.

If they do not pay Feb rent, you have to ask the BK judge for permission to pursue the matter per your normal collection/eviction procedures (it's normal after the BK judge approves it).

When you file BK7, imagine taking a snapshot of all the debts you have ON THAT DAY. Those are the ONLY debts that get wiped out. Any debts you accrue after THAT date are still owed by you after yiur discharge. --174.234.xxx.xxx
