I have a 3 family house. I occupy one unit. Each unit has its own garbage barrel that is labeled accordingly. The garbage is collected once a week by the City. The lease indicates that the tenant is responsible for taking their own designated barrel to the curb each week for garbage pickup as well as bringing it in from the street after pickup has occurred. The day of garbage pickup (Friday) is also indicated in the lease.
This seems to be an issue for almost all of the tenants I've had. It is clearly written in the lease and we go over it when signing the lease. Is it unreasonable to expect tenants to wheel their own designated garbage barrel to the curb?
I understand that it's possible to forget that it's garbage day, but shouldn't the fact that the whole street is lined with barrels refresh their memory? It seems like they would prefer the barrel to be overflowing and full of maggots. --76.23.xxx.xxx |

Change your approach. If I lived in a 3 unit building with a garbage situation like this, I would probably just put 3-4 large cans with wheels outside and wheel it down myself once a week to the curb.
You probably won't get them to do this, obviously. Plus it's not worth the drama in a building you live in. I would imagine an O:O multi unit would have to play by a few different rules than a normal multi does.

Silly situation. If my neighbors didn't see me put out my own garbage cans for the weekly collection, they would forget. And they are home owners with kids....who could help.
In my dozen's of properties with 100's of tenants, only a few do put out and collect their own cans. I "have to" provide a service to put out the full cans and around half of my tenants will take in the cans within a day or two.
Since you live there, I would just take out the can's yourself.

I haven't heard it called a "barrel" since I lived in MA myself. Do you recall when they used to pick up "swill" which was dumped into a canister in the ground which was a bucket and there was a pickup day for that? I was told it was given to the pigs at the pig farm in the town where I lived and it was food garbage. OK, I had two four plexes next to each other so that is eight garbage cans which is what we call them here in NJ. So typically about two people per week did not put their can out on pickup day. I live on the same street so I would take a look and put the offending can on the street to avoid stinks for the first floor tenants in spring and summer since the cans were under their windows Tenants forget the night before and rush off to work without putting the cans out because they are dressed for work and don't want to get a stain on their work clothes. That's the whole thing. I have done the same thing myself when I was working elsewhere. So I would recommend keeping an eye on the cans and for you or someone who works for you to put the missed ones out and give the person who forget, a note about how important it is in warm weather due to smell and pests. --173.61.xxx.xx |

My thinking on this would be : this is going to be a never-ending battle. All of those expectations ARE reasonable but, yet, daily in the city I see people open car doors and drop trash out. Get out of vehicle and drop potato chip wrappers. Me, I would buy either wheeled carts, or, if you are required to use barrels provided by the city, then buy or make carts those barrels can be hauled on. Lifting a full trash can, when I am dressed to go to the office,? Nope! But, wheeling or pulling a cart, ok. Then, increase the rents at your units, and you haul to the curb. So, the tenants pay for a nice looking exterior that they don’t have to maintain.
And, some good tenants will, on their own, help out. But, yes, others will just live with maggots, and when their bins are overflowing, they will use the recycling bins, or, the other tenant’s bins.
Make trash containers easier to get to curb by getting wheeled bins/ carts. Tape copies of the trash pick up schedules inside the lids of the bins/ carts. I went around and did that just this week at all of my single family homes.

How far is it to the street? If I lived there, it might be easier to do it for the other 2 units. I would add in either a fee for you to deal with overflowing trash or maggots. Occasionally I get a renter like that at one of my multis. I will deal with it and then either have a discussion or post a lease violation on their door. If it happens again, I will give them until the next trash day to deal with it or let them know what it will cost them if I have to. Most times, one time us all I have to do to get them trained because they are embarrassed when I explain what I had to deal with and although professional, they know I am not happy and not going to tolerate it. It is unacceptable behavior and impacts the health and welfare of all that live their on top on attracting rodents and animals. --24.61.xxx.xx |

Unfortunately it’s a never ending challenge, in my area there are companies that will come specifically to your house, get the barrels and put them back. This is an immaturity regarding the relationship between landlord and tenant, and the drafting of a lease agreement.
The tenant is NOT responsible for taking a garbage can to the street whenever the landlord dictates it, regardless of how the lease was drafted. I don't know anything about MA, but I don't believe that such intrusiveness into the tenant's life would be allowed, MA or elsewhere.
CA law says that
"No duty on the part of the landlord to repair a dilapidation shall arise ... if the tenant is in substantial violation of any of the following affirmative obligations ...:
(1) To keep that part of the premises which he occupies and uses clean and sanitary as the condition of the premises permits.
(2) To dispose from his dwelling unit of all rubbish, garbage and other waste, in a clean and sanitary manner. "
and I believe that CA, MA or elsewhere, that is the limit to which a landlord can obligate the tenant to deal with garbage.
The tenant is NOT the landlord's servant who can be ordered to perform tasks. He has rented the property and he has certain obligations regarding health and safety, but outside of those obligations, the tenant is not obligated to the landlord to fulfill those obligations according to landlord's schedule. There is no justification for such an obligation. In any case, such a clause does not belong in the lease, because that is NOT what the lease is for.

I disagree Moshe. Many towns have ordinances about when trash can be put out and how long barrels can be left curbside or even if barrels are allowed. Aligning your lease to city ordinance makes sense. The city of my multis developed a rat problem last summer and as a result became very strict about how and when trash/recycling was put out including fines if neighbors turned people in for non-compliance. --24.61.xxx.xx |

YES, SL, but an ordinance specifying when trash may be put out is different from landlord trying to compel tenant to actually put his trash out on that schedule.
If a town has passed an ordinance to solve a health problem, then the tenant is responsible (to the town) to comply with the town ordinance, but not (to the landlord) with a schedule composed by landlord.
An ordinance to solve a health problem makes sense. This lease clause does not.

If so I disagree, at least in MA the LL is responsible for the fee’s associated with trash disposal you are correct, but the tenant is responsible for coordinating getting the trash to the point where it is collected and disposed of. If a building uses dumpsters, then the tenant is responsible to get the trash to the dumpster, if the building uses barrels and curb side collection, the tenant is responsible for getting the trash to the barrel, and the barrel to the curb to be collected. How is expecting a tenant to fulfill their obligations immature. I had this problem at a multi. I had the wording in the lease and nobody cared. You have to think like a person who is too lazy to roll the trash barrel . They certainly don't want extra work so they will be smarter when faced with the threat of extra work. When the barrels are left out on the street I roll them right into the very narrow driveway. Now they have to get out to move the barrel to their unit and walk back to their car. All the barrels are labeled so everybody knows who the jerk that didn't move the barrel is. --71.10.xxx.xxx |

My lease says a tenant has to provide their own trash can and follow local ordinances for disposal. I also give them a copy of the ordinance and a list w/ fee schedule for discarding bulk items. If I were you I would want no part in putting out their trash. For example; suppose it contains recycled items and you get a ticket? It is you that put to the curb. I have a 4 family and tenants always leave them at the curb and blowing around. Once in a while I remove the cans that don't have lids anymore and have not been taken care of. As much as I'd like the building to present better to the neighbors, I'm not going to babysit the trash cans. --24.194.xx.xx |

Town charges me $95 to replace a broken or stolen trash can, I charge the tenant $125. They all seem to take care of the cans but I am not running around on trash days to find out exactly when they put it out and when they pull it in.

They agreed when they moved in, they made the garbage, they should do as they agreed. Otherwise, I would send a notice that they need to comply or pay an additional $ for the service. Let them choose. They will push you to see how much you will put up with before you get serious and hold them to their agreement.
