Need some advice from fellow NC landlords that have MHP's.
Is the "Complaint in Summary Ejectment" (NC AOC-CVM-201) used for summary ejectments of tenants renting a MH lot as it is for residental or business property?

Has been too far in the past to remember all the details, but some of the laws in NC about evicting from mobile homes are different than those for regular dwellings.
Be sure of the laws before filing-- or your fees might be wasted-- and time lost.

All I can find is that you must give 60 days notices on MH LAND as opposed to 30 days notice on regular rentals to end tenancies.
So it's the same form, it seems, but more notice.
That's to end tenancies, I don't know about summary ejectments.

And beware, it's apparently not easy to evict the MH itself. If it's older than a certain age, it can't be moved, must be dismantled and hauled away. Likely the tenant, if not paying rent, can't afford that.
We had a case here locally where the tenant was evicted, but couldn't afford to destroy the trailer, and Land Owner not allowed to do it. So it sat and deteriorated - then MH Owner graffiti-ed it himself, it was a really eyesore but not illegal. Someone painted it over in the dead of night but it is still there. --50.82.xxx.xx |
