I have a 2 family rental. The first floor tenant wants permission (free) to use the basement for her 2 sons (9&10) to play in the basement.

And

to put a refrigerator in the basement.

You may give permission, but do you want to expose yourself to liability for kids playing in the basement, and who pays for the electric for a refrigerator there. Also expect all sorts of other things to be stored and thrown there.

No. Your heater is down there and electrical boxes etc. Too dangerous. I don't know how you will stop them except by amending the lease if its month to month, and sending them the change. Is it a common area with access through a Bilco door? I have allowed tenants to use basements because laundry equipment is down there. One guy put his son's bed down there after he produced another one while he was on unemployment. I had to fight them on that and evicted them and had to use cash for keys to get rid of them. Numerous other issues too. Someone the parents rented to before I took over. Tenants will try to take over any extra space there is so you have to make strong statements in the lease and even then they will fight you. AT one place the parents rented to a woman with two little boys and they played gas station and ran water from the outside hose into the oil tanks. Again, before I took over. Explain about the equipment in the basement and tell her you will evict if they turn the basement into a playroom. Find a statement in your lease that covers that. Make sure you also have a reason to check basement equipment every month now. --173.61.xxx.xx

I wouldn’t in a duplex or multi family. To my way of thinking, tenants in a multi family have enough to squabble over. I only do single family homes, so, yes, they can let kids ride trikes and such, but, we have had to monitor a few equipment things. And have had as AllyM had; tenant let grown kids move into basement. Nope, no sleeping in basement.

If a bed is put down in the basement then if there is a serious fire then insurance may not cover as it is not legal to use a basement that has not been retrofitted for people to live in. No way as this can lead to many problems. Get a copy from the town hall about building and fire codes. For starters there must be one hour separation between the heating area and where people live. Windows that one can egress. It would be extremely expensive to convert a basement to a living area or basement apartment. --147.194.xxx.xx

you just can't make this stuff up !!! Even my kids and grandkids didn't think of this one.

But ... way down on my to do list is to cap off an oil fill in a building that was converted to all electric a few years ago.... guess I'll move that chore higher on my list. --72.70.xxx.xx

No, as in NO, as in ABSOLUTELY NOT!! I wouldn’t let my 8 year old play in my basement without supervision. Hell would freeze over before I’d let a tenants kids play in a basement. First the obvious, there’s to much they can break, or can hurt them. Then they say “to play and put a fridge down there” AKA make it the kids playroom. You are asking for trouble, kids getting hurt, to many expensive things to break. Think about it, it’s an unfinished basement correct, the kids aren’t exactly going to be down there reading books, playing UNO, and Monopoly! Then what will tenant number 2 say on the second floor, they want to have access down there too, or it’s unfair, they don’t have access so their rent should be reduced.
