Tenant did not pay rent for March. She stated her purse had been stolen along with all of her identification. I gave ample time before filing an eviction. In fact I gave her more than I should have because she had been a good tenant until this month. Court date was April 8th. Today she sent me a text wanting to know how much it would take to cancel the eviction. I told her 2 months rent - this month AND next month plus $200.00 in late fees and $135.00 in court costs to file the paperwork. It was deposited into my bank account within 2 hours. I sent the judge an email asking him to drop the eviction. Definitely a 1st for me! --64.184.xxx.xxx

Great for you! I just evicted a tenant w/ same story, only she didn't want to pay to stay. I asked her to file a police report and then get me the report # and then a copy. Well you can guess that never happened. BTW tell her to get renters insurance and it would cover such a crime. --24.194.xx.xx

What is funny is you have not SAVED her record. When you file anything with the court its PUBLIC record. So even if she paid the court action will say dismissed but the original file will be there-- well a long time.

I like others never heard of a case being dropped by email? You should send a signed dismissal.

Great that you got paid-- another instance of LL being told sob story for something LL has no control over.

With these I still attend court in person, never heard of emailing anyone in court staff to do anything - they are overworked and only a few have fulltime hours now, but some years back I did not show for a hearing that was paid off - hardly ever happens but tenant came with pictures of stuff broken and within 2 weeks the city had put the house in for demolition, my nephew and I lost a lot of time just touring inspectors thru after making many minor repairs, some were charged to the tenant but the real wake-up call to do inspections came front and center.

Bill the tenant in the next rent cycle was born about a year later after agreeing to a payment plan that always went sour and the deposit was way short after moveout.

Congrats! She made good on the problem.

Me? We file a CONTINUANCE FOR 30 DAYS in case this was the beginning of problems.

My court will not accept emails. You need the judge's signature on continuance or dismissal.

Indiana courts will accept a LETTER TO THE COURT in plain English using the terms DISMISS or CONTINUE.
