Ended up picking a 20 something guy and his mother on Social Security to rent out a 2 bedroom apartment. They seemed nice enough.

Until they moved in, that is.

First, the son is constantly calling, even at 10:30 at night. He complains that the landlord isn't available when he needs one, even though he doesn't really need anything.

Also he tells me he thinks texting is rude and unprofessional, and wants personal 1 on 1 calls.

But it doesn't end there.

The units all have boiler heat and no central air, so the lease since the beginning for all tenants has stated tenant can bring in window AC units. We don't service them, and tenants can take them with when they leave. And so they have. I've had 2 other tenants in that very apartment before these, and it was no problem. Not only is that stated in the lease, but I read the lease to these two on signing, and then walked them around showing them where to plug in the AC units when they get them- even discussing the installation, and saying I'd stop by to make sure they looked all right.

So around 10pm tonight, I start getting texts. First from the son, and then from the mom. "Mom says you told her the apartment came with AC units". No, I said, renters provide their own AC units. "THIS IS UNFAIR! THE AD SAID AC INCLUDED! THIS IS TOO MUCH FOR AN APARTMENT WITHOUT AIR!" "THIS IS A FREAKING RIPOFF" etc etc.

Then they're both coming at me at the same time, assumedly texting from different rooms. "Mom says she saw an AC unit in the closet when we looked at the house".

No, there was no AC unit in the closet. "I would never have rented this apartment if I knew it didn't come with air". "Hotpads stated this apartment had AC!"

I replied that no, it didn't, apologies for the misunderstanding, and none of the other tenants have ever complained about it. Reply: "Excuse me, Complain??? Thats awful unprofessional of you!"

And on and on.

And then a strange text: "I gotta pay hundreds of dollars for a freaking AC unit I'm only going to use a few months???! What a ripoff!"

A few months? Didn't they sign a year lease?

So, what's anybody's guess. They moved in, and now they want out of the lease?

Or are they setting the stage for bigger accusations.

The weirdest thing is, its not even warm out yet, in fact its about 40 degrees out the night they're both texting.

"My son can't go without AC he will get sick he can't stand to go without AC because of his asthma and allergies.

I have never heard of an appt our house without AC or AC unit always was the landlord responsibility never ever would I have thought to ask I am extremely upset this is extremely upsetting I can't stand this is unbelievable so unbelievable"

And from the son:

"This is very wrong! The ad in Hotpads states there is AC. "but they did take the units with them" you said. Well, hot damm. I hope so... Making the tenant buy their own AC. What a Crock.

They bought them...."

Frankly at this point I'm worrying that maybe both of them are mentally out there. They've sent about 10 texts each over the course of the night about this, and they keep coming.

Never encountered this before. In fact, I've never had a tenant even complain once about the AC arrangement before.

I think I'm catching on.

This appears to be a "where's my free toaster?" mother & son scheme.

They are play acting as outraged and angry customers who want to get free AC units installed because that's the deal they saw advertised. Or at least, so they claim.

And if they yell loud enough..... they think they'll get a bonus even though they both knew that's not what the lease stated.

I got that from the mother's last text, which said, "Please speak to whoever is in charge about this."

The only other explanation is they're both insane. So I hope its the former, lol.

Well. I guess the only questions are.... what will happen if they don't get the bonus. And if they do, will they want something else next?

Tri,

Yes there are insane people, sometimes in our homes. Still looking for a way to screen out CRAZY or "sometimes I don't take my meds".

Congrats on being the manager not the owner as evidenced by the "Whoever is in charge" comment. Helps keep you safe.

If I truly believe they are wacko I don't want crazy people and possible violence in my life. I give them the Happy Clause

"We want you to be happy. Obviously you are not happy here. If you will move out by March 31 I will release you from the lease and return your deposit if there are no damages or cleaning."

With this most get quiet. Some leave.

Presuming they just recently moved in, I'm thinking that once they started living there they either don't like it or more likely a place which they "think" they might like has become available to them.

As others have said it's definitely time for the happy clause. I think I would send them both a highlighted copy of their lease and the original ad along with my offer to either stop this nonsense or move.

Never take a mother and a grown son. There will always be a problem with the son in my experience. Also if both parents or the mom shows up at showing and hovers. I have had a few of these. They probably saw the weather report that you will be having May like temperatures in your area this week. One thing that would cause panic about high temps is if one of them is schizophrenic. The meds for that don't work in warm weather. There might be other psycho meds that don't work well in hot weather too. I would go today and find a room size AC unit. Put your name on it in magic marker and loan it to them. TODAY. Or you will have no peace and one or two psychos next week in the May like weather. --173.61.xxx.xx

It maybe time to consider in the future to convert out heat where tenants control and pay for heat. Expensive upfront but over the long term lower operating costs. A high efficiency heat pump will do two functions. One heat and the other cool. The tenant can control the heat along there air conditioning. Even if a air conditioning was installed doubt these people would end complaints. They would find something else. The housing authority does not have air conditioning in rental units. Heating is more important. During March the outside temperature is close to freezing so why in the world would air conditioning be required. As the economy improves avoiding people on social assistance maybe a better option. They have absolutely nothing to do all day and night where they only wait for a cheque to arrive at the end of the month. Most of them are able bodied who could get a job yet refuse to do so. Social assistance was meant to be a temporary help not a way of life that is a never ending story. No military conscription here meant if someone did not come back from overseas the family did not suffer. Governments need to make tough decisions where legislating work fare not welfare. Anyway - I would advise them that if they are not happy here that's fine - leave. I don't know what your laws are but you may want to "try" to get them out by the 31st (if they have somewhere to go) and if not then by the end of April or as soon as possible (before the end of April).

Leave the place SPOTLESS with not damage within the allotted time frame and yes, I would even offer them the SD back in full (as long as there is no damage, etc). If there is, then deduct accordingly.

Don't rock the boat with them. That offer is a one shot "take it or leave it" deal. They cannot take the offer later. Time is now or never. Get out now - or stay in the lease and move out at the end. What's the decision?

That's exactly how I would run it. Don't falter, don't get into it with them. Print out the ad if you feel you have to. Also, I don't know if you have mentioned in your lease but if you don't - make sure it is in the future (AC units allowed at tenants cost, blah, blah).

If they choose to stay - then they need to stop with the comments about it. I would personally push for the get out now though - they will come up with a lot of stuff (especially now that you know the son supposedly has asthma). DO NOT - I repeat DO NOT provide AC units. Ugh, I am so sorry about the annoying tenants. I see from your earlier post as JB noted that they just moved in. Had I read it, I would have cringed about the son who seems like he applied to a job but didn't have one; hindsight is always 20/20.

If you let them out of their lease immediately, I wonder if they are going to ask you for extra money as backlash besides whatever is left from their security deposit? They sound that crazy. If they do move out soon, I'd love to hear if any new prospective landlords call you for a reference. Ask here for a letter of early lease termination if you need help. Tip: Happy Clause must have a deadline. I learned that the hard way in court months later. Resident showed the judge my Happy Clause email and said “he said je would let me out of the lease”.
