State Specific Question About: CALIFORNIA (CA)

Last week, tenants lost a UD suit. So, depending on the Sheriff's Dept. timetable, they'll be removed soon. As of this writing, that should be in about 10 days from now.

Suppose the tenants trash the place.

Can I do anything to discourage trashing?

If trashed, what can I do recover that loss from the tenants?

Thanks if anybody has advice. Your advice given earlier about the UD process was on point and effective. --108.251.xx.xx

In NC it is now a misdemeanor to deliberatly damage a rental unit. And if it's over a certain dollar value, I assume it would rise to the level of a felony. --50.82.xxx.xx

You have your security deposit. Thats what its for.

If you have damage beyond the SD, you can go to Small Claims Court.

With a 24 hour posted notice, you can go inside and take "time and date" stamped photo's. I always take pictures before I have the tenant served with the Unlawful Detrainer Actions. Then I also take more pictures a day or two before trial. Then I take more pictures during the Lock-out (will not take photo's of Sheriff's face, but of their name ID and Badge. This will match the name and badge number on the document given after the lock out giving the owner possession).

If there is more damage, then I document it. If deliberate I can file a police report. I get estimates for the repair. Then I submit a "letter of demand" to the tenant. And follow it up with a case in small claims court. A lot of work from a dead beat tenant who skipped out on rent already. --47.156.xx.xx

What to do? Bill tenant for current damages - how? Inspect every 3-4 months and Bill for existing damages in next rent cycle - no 200bux payments, took 30 minutes or less to create damage and 30 days to payoff in full, this is called wallet training and should happen more in this business than it does.
