What are your thoughts on marijuana use in rentals, I had a person I was showing the apartment to yesterday tell me that I could say I didnít allow smoking but I had to allow medical and recreational marijuana use because itís legal now. Especially medical use because ďitís a medicine dudeĒ I just ignored him, finished letting him look at the apartment, thank him for coming, and now have his application in the denied file. But my belief is that itís still federally illegal, therefore even though the state has passed laws legalizing medical and recreational use itís still illegal and I am not required to allow it in my rental. Now Iím not trying to start a debate on whether we agree or disagree with marijuana being legalized, Iím just trying to get your thoughts on whether we are required to allow it now that it has become legalized. --71.248.xxx.xxx

Medical is also available in pills or caps...

While the first use of it was and is a medicine as long as it is Federally prohibited don't do it...

As for smoking it.. same problem with tobacco..leaves a film in the surfaces and odor --162.247.xx.xx

I agree that we should be able to not allow it to be smoked regardless due to the lingering smell etc.

However if someone has a prescription for it for a disability I donít want to be the guy who makes case law for not allowing reasonable accommodation. It doesnít seem reasonable to me but you never know what someone else will interpret to be reasonable. When (not if) I have someone with a prescription who is adamant about smoking inside I will consult my attorney and take my advice.

Iím willing to bet that any of us who have 10 units or more have at least one tenant who is regularly smoking the stuff inside our unit whether we want to admit it or not. --70.178.x.xx

Let them do whatever they can afford, here it costs 250-300 for seal-prime-refinish without wall repairs which are pretty low cost by comparison. Just add damages to next rent cycle without dividing, none of those extra 250 a month payments.

In my opinion even if your attorney advised to allow it that doesnít mean you have to allow the smoking of it. I donít know about anyone else here but I HATE the smell of that more so than tobacco. Gotta believe other tenants in the building share my thoughts on the smell. You could allow edibles, infused products, and vaporized oils only. Not that any of us would even know if someone is currently using edibles or infused marijuana products currently. Not legal in my state. But it is everywhere. Too widespread to stop. Police donít bother with it anymore.

I donít care if they smoke it, eat it, whatever. Iím not the police.

BUT...

To your original question we do not allow smoking, vaping, etc of ANY kind inside the home. They can smoke it outside.

As far as a REASONABLE ACCOMODATION for a disability they are free to smoke in the designated area- outside.

This was a discussion at a LL meeting. The attorneys verified that if you donít allow smoking, then they canít smoke anything. You cover yourself by putting that in your lease and making the ENTIRE property smoke free. There was a judge there also. Her opinion is that the only way it would be a reasonable accomodation is if there was absolutely no other way they could ingest it. That would be an extremely unlikely scenario. --71.10.xxx.xxx

I would deny the applicant for "telling me the law"...it would have zero to do with MJ or no MJ. Glad to see you denied.

As Brad said...outside smoking only. I treat tobacco smokers that way, so I gotta be fair to everyone.

I think there could be a niche market in catering to indoor smokers. Double security deposit (or max allowed by law in your state) and each year require they have to pay for someone to come in and wash the walls, just to keep the residue from building up and getting too ugly. Hire a smoker to do it the washing. Charge 15%-20% above market rent for "smoke indoor here!" property. --173.20.xxx.xxx

Unless it becomes an issue with other units in the same building, I don't lose too much sleep over it. I'm sure that you especially if I remember correctly being an owner occupant of 2 family could legally deny them. However I realize that most times it's much better to be rich than right. Therefore I would never deny an applicant on the basis of their having a medical prescription to smoke a joint. I know that I & I imagine you could find another reason to not accept this applicant.

JKJ, I'm surprise to read that you put this person's application in your "DENY" file. Unless I actually deny an applicant as a result of their credit report, all unaccepted applications go into either the incomplete or the not approved files.

I had potheads living in one of my units. When they left there was no lingering odor. I'm still not crazy about about the idea of tenants who smoke weed every day, but I guess I would rather have them than tobacco smokers.

The medical probably has to be allowed but tobacco was legal and you could disallow it. NJ is legalizing too. I hava a duplex with none heater and that is going to continue to be SMOKE FREE. NJ is a POS now with legal pot and sanctuary city and they gave 1.6 mililion in taxpayer money as college tuition for ILLEGALS. --73.248.xxx.xxx
