I just got a phone call from a gal I showed an apartment to last summer. She and her boyfriend who I make a posting here about as he dropped red flags all over at showing

Will you work on deposit? Can I paint for rent?

Then I spelled his name right and found three evictions in the past 2 years with his prior girlfriend. Old girlfriend was making payments on all evictions and had 2 of 3 paid off, with no payments from him. New girlfriend had a good job and no negative records. He called about 4 months ago and I refused as he did not meet my criteria for job time and had prior evictions.

Just for kicks I reentered his name last week and he was evicted again in December with new girlfriend. She is no longer stellar.

So tonight I get a phone call from a lady and my last 2BR is rented but I have a 1BR coming up. She wanted the address and I wanted info first. She stated they were renting but Landlady was going to let them out of :Lease because basement flooded and Landlady was not going to do anything about it.

I asked her name and she said P_____ S____, the same unusual first name of red flag dude but now she had his last name. I said(forgive me), I can't believe you were foolish enough to marry that man, he has 3 prior evictions with his old girlfriend and 1 with you. I do not accept ant person who has been evicted in last 5 years> Thanks for calling.

She immediately calls me back and I ignore and block her. Then a new number lights up but I ignore that too as I figure they are just using a different phone.

Then I get two texts fron the 2nd different phone:

1. Hello this is MS and I legally got the one eviction expunged from my record, so legally there is no eviction at this point.

2.If this is a discrimination issue I do not have a problem with pursuing it.

So I ran him again on state website and everything is wiped clean even old criminal records and all 4 evictions, but their last eviction from 12/2018 is still present under girlfriend/now wife's name with no mention of him. I blocked him too.

I figure she still has an eviction on record and he is very bad news. Would any of you try to communicate with him?

He just sent a third text, "Thank you very much Miss ____ with my full name. I guess he has great caller ID. --216.23.xxx.xx

My husband always tells me, don't take it personally, IOW, don't get mad about what people say or do. He also tells me it isn't always a good idea to let people know "that you know".

It is a no win situation. They are not going to change because you "caught" them in it. Because in their minds, they haven't done anything wrong!

So, as hard as it is, let it go. It truly is a very frustrating part of landlording. Just be glad you avoided getting snookered in by them, they are pros. Just get your ducks in a row in case they file a complaint against you. Have some good reason, like you said time on job, etc. --71.219.xx.xxx

Sometime earlier, I learned from another LL on this site, NEVER get personal with the tenants in this business. Don't volunteer any personal information besides a name and number, never allow tenants my home address or more than very general information, not my political leaning or judgements on their lifestyle..

AND I don't give specifics on why they were denied, I say "the application does not meet the rental criteria". We all know it's usually clear the reason is your #$%^$ poor credit history. I say that because whatever the other issues are, court records, etc, these things always seem to travel with poor ^&*% credit history. --100.15.xx.xx

expunging civil cases is in vogue now, many areas doing this, in my big city they only allow it if the judgements are paid off for 5 years and the plaintiff landlord allows it.

Pay VA said it well, best to keep your steady face and remain on top of a bad situation, easier to avoid trouble than get out of trouble.

BTW, I never tell them up front what I found out about them. I just tell them, NO. Other than that momentary feeling of satisfaction that they know why I am rejecting them I prefer to not give them a heads up. Documemt document document.

Print out that eviction and staple it to their app.

Expunged?!?

Be certain you can find that app 2-3 years from now. She has two years to file a complaint. Your response attacked her love life so she must retaliate.

LLs get in trouble or make trouble by what they say. I don’t want my tires slashed so our offical phrase is “The office did not approve the application.”

Notice I did not say *I* denied YOU.

Another reason we do not answer the phone - cannot argue.

I pre-screened over phone Brad no application and I printed the eviction report anyway. Since I showed a unit to him last summer, I check who is currently evicting him. He performed very badly at showing and he is a smoker who I do not rent to. One of my pre-screening criteria before I show is no evictions in past 5 years and no more than 3 in a lifetime. --216.23.xxx.xx

Yeah took advise I learned from from this site, I don’t tell prospects no in person, and I don’t tell them why, in fact I don’t tell them at all. If they call me back or email me following up I tell them there application was declined. If they ask why I tell them they need to mail me a denial request in writing and to include prepaid postage envelope with return address and it will be mailed to them. I have had nobody mail me a request yet. I definitely don’t get personal, way to easy these days for some crazy to find out where you live. --71.248.xxx.xxx

I've made the same mistake too. I try now not to get into discussions or arguments with these people once the decision is made. It isn't worth it.

Sometimes I think they are just ready to lash out at anyone because they've recently been denied at several other places-- usually large, professionally managed places. Then they go to "private owner" thinking there won't be any screening and when they get turned down again they explode. --72.188.xxx.xxx

Lana, it appears you are feeding into tenant drama, if not urging it. Shouting personal insults at tenants solves nothing. In another post, you said your husband shouted to a tenant "come down here and say that" and you responded "don't worry, he only hits women".

it's a good thing when you learn to say what you have to say in a tone and manner that they understand you are serious and what you mean ... without shouting, name calling, etc. Not sure of your age but it takes a while to perfect. When you do, it works wonders. --72.70.xxx.xxx

Nicole I am retired, but too used to telling people what I think they need to hear. That comes from years of being a family doctor. The telephone prospect was going on about her newest landlady and all the things wrong with the current rental and how they were being let out of their lease because Landlady did not want to fix them. I asked her name, recognized her and gave her some of her own medicine. The yard confrontation was 20 years ago and tenant had threatened my husband in person and by phone, he had lied in court, and I had seen his exwife too many times after a beating.

I am a true redhead at times and never back off a fight. Not sorry for either instance. Both of the long ago tenants ended up in prison where they belong. The recent couple I had been following after my encounter with them last summer. Every time I have opening since last year, I have heard from them as he is once again between evictions. I want him to never call me again.

I read up and found out records can be expunged in Indiana and that is scary because I rely on the courts website a lot. Some of the other people I follow now have clean records as well. --216.23.xxx.xx
