the tenant is breaking lease, leaving a couple of weeks before termination of her lease..what do you suggest, be grateful she is leaving or do a pay or quit, or evict? I have his security deposit. --24.18.xx.xxx

By "a couple of weeks", I hear "14 days or less", and by "termination of her lease" I'm curious as to whether this is "the normal time when her lease is up and she has to leave anyways" or something else.

Today is March 1st. Are you saying the tenant is skipping out without paying the last month, because they plan on being out by midmonth anyways, and they're using your rent to help them move into their new place? How much of a grace period does Florida give? The end of the day after it's due, or something else? Have they flat-out told you, "We're not paying"? --96.46.xxx.xx

Just follow your local and state tenant laws, inspect and get repair estimates once you get the keys and new address so your bank can get a check to them after the reductions plus the rent payment that is unpaid.

Rent is due today, no grace period in lease(expires march 31) Sorry, "she" said they (she and her husband) are not going to renew lease and are leaving March 15th. There is no early termination clause in the Lease, but Lease does say security deposit is not to be used for last month rent. Nevertheless, she wants me to use her SD as payment for last months rent even after I told her the Fl law governing Security Deposits. People tell me she has been seen with moving boxes already. I am notifying the Association (who has her application and lease on file) that she has given me notice via email that she is leaving in 15 days and that she did not pay her rent for this month. In case she decides to rent elsewhere in the building. Also, no eviction because of time and costs but I am reporting her to the Credit Reporting Agency when she leaves. I am an out of state owner and landlord. --24.18.xx.xxx

Well then i wouldn't tell them you could, will or may use deposit if they short the rent. They cant use deposit for rent but you can, just keep that to yourself. So are they asking to pay on half or are you assuming they are not paying anything for March? If they dont pay anything then the late fee will apply! --99.203.xx.xxx

Best to file eviction now while you have a good address to work with, it is hard to collect while chasing frogs, they just keep slipping away. It sounds like you already told them about the deposit problem and eviction is the only option now, what will you do when they allow some guest to stay after they have left?

I will ask a friend on the Board to get the keys when she moves and guard my place until I am able to get there. She's taking photos of the condition of the place when she moves, she said, "maybe to get her deposit back?" but she's not getting it. Her SD is equal to her monthly rent which will cover that, but cross my fingers that the place is left clean and damage free. After reading Florida Statutes, I am going to revise my lease and next time, I will go item by item with tenants and make sure they understand what their obligations are before they sign. True, some people do not read their leases. I will do better tenant screening, not get relatives references but get verifiable references...not overlook credit score...pay attention to attitude. I had a gut feeling about them, now I know better. Thank you all for your comments. --24.18.xx.xxx

yes, she said she was not paying the rent and asked me to use the security deposit to cover the rent for the month. I told her it couldn't be done, the lease says so..she still refused to pay her rent today. She did not pay her rent today. --24.18.xx.xxx

They can leave anytime they want, most do not stay until the very last day. We cannot chain them to the house, BUT we CAN enforce the written lease.

You know you will lose money her - just don't know yet how much. If the SD is enough to just cover the unpaid rent, there will be none left for late fees and damages. You know there WILL be dirt and damages. If they just told you today, the day rent is already due, they did not give you proper notice, so they may (check FL law) owe you for April too - if you can't get it re-rented that fast.

Send them a notice NOW as Brad described, and move forward quickly to file in the courthouse on the FIRST day you legally can. Eventually, you will have to go through the court to get a judgement of money owed you - so start now. AND, what if they change their minds and stay!? --68.10.xxx.x

I'd file.

Hopefully, they will be out and you won't have to follow through with a court appearance, but in the meantime, the filing will go onto their record and give a heads up to future landlords. I agree with DJ on that.

Have you tried asking her for the two weeks rent so that you don't have to file an eviction? Maybe she would pay that and you can take the rest out of her deposit. --98.146.xxx.xxx
