Please forgive my ignorance in advance its been a while since I had to file an eviction. My judgement is dated 2/20/19. When can I file for possession? Do I have to wait for the 10 day appeal period before filing for possession or can I file today? Thanks and happy renting.

Yes you need to wait 10 days. I've waited 10 consecutive days and 10 business days in the same office. Call and plead ignorance and ask when you can file for OOP --97.35.xx.xx

Well sorta........they will have 10 days to appeal. Which can be 10 days, unless the 10th day falls on a weekend or holiday when they can't appeal. In such cases they have to the close of business of that Monday to file.

This filing is appealing possession.

They have up to 30 days to file for money owes......unless the 30th day falls on a weekend or legal holiday --72.23.xxx.xx

You have to wait 10 days but I wait like 12 or 13 just to make sure. Call the court where you got the judgement and ask if they can see an appeal in the system and if not just go ahead and file. If they filed an appeal, its no big deal but I normally hire a lawyer to go the court of arbitration. Professional tenants use this trick to extend their time living for free. If you get possession the constable will post the property and they will have to be out by that date. If not you can take the constable to go with you and change the locks out. I don't do that but that's just my style. I get the constable to go and collect keys for me. I also give an extra day or 2 if they need beyond the eviction date. --76.125.xxx.xxx

Ten days is the appeal period, but it is also the period that you must wait to file for the first writ--they run concurrently. You have to actually wait until the 11th day to file, and if the 10th day was a holiday or weekend then you must wait until the next business day and file the day AFTER that. Then, whatever date the sheriff actually serves the writ, you must wait 11 days. On the 12th day you can file for the 2nd writ, which actually gets the bums thrown out. Same deal as 1st writ if the 11th day falls on a holiday or weekend. --73.141.xxx.xxx
