I've seen some people mention their lease includes a fee ($30-50) when the LL has to send a Pay or Quit notice. How do you word that ? Is it enforceable? Is it different from just rolling that amount into the late fees you charge?

As part of the "RENT" clause in my rental agreements I have the following;

Any returned checks are subject to a $35.00 service charge. Rent received after due date is late. Fourteen Day notices can be issued as soon as rent is one day late and tenants understand that there will be a $30.00 service cost to cover the cost of creating and sending this notice plus any additional legal fees involved.

I normally will make one attempt to have the tenant sign for & acknowledge receipt of their 14 day notice. If they do this the cost ends at $30.00. However if they won't sign for it, I turn it over to either a constable or a sheriff. This results in an additional charge of $50.00 to $75.00 depending upon how much the constable or sheriff charge. So far I've never had these fees challenged when we end up in court. --96.237.xx.xx

It's under Late Notice Fee and Eviction Fee:

After the ___ of the month, The LL may demand rent. This demand may be verbal or in writing. If the LL mails or posts a Pay or Quit Notice, the fee to the Tenant is $100. If the LL initiates or files and Eviction, the fee to the Tenant is $500. Typically the Pay or Quit Notice is posted between ___ and ____ of the month. You need to check your state and local regulations for what you can and cannot for. You can put it in your contract anyway and hope that it doesn't come in front of a judge, but if it ever does then your whole agreement could be suspect and the judge likely won't be kind to you... --24.20.xxx.xxx
