A fire has made on of my apartments uninhabitable, fire department placed red tag stating unit cannot be lived in. Tenant has not moved much of their stuff out. It is almost a month and this will negatively affect the remediation and rebuild schedule. What am I able to do to get the tenants possessions out of the apartment? What notice is required? Do I throw away or store at the tenants expense? --100.8.xx.xxx

I've had fires in 2 multis. Once the fire department returned the fire scene back to me I notified all of the tenants of the hours that someone would be on site to allow them limited access to the building. In this same written notice I said that in order to get their SD returned all items they wanted would have to be removed within 10 days & they would have to sign a release stating anything left after that date was trash & unwanted by them. I would think that you should be able to do something similar. --96.237.xx.xx

I had a fire in an apartment last year caused by the tenant. This tenant want's to move back into the unit after the remediation and repairs are complete. Going to take a year dealing with the insurance company.

The tenant has refused to remove her stuff or give up the unit. I couldn't proceed unless the unit is empty. So I gave this tenant a Notice, "Move the stuff out of the unit ASAP, or loose it"!

The tenant still wouldn't budge. So I hired a hauling company, just to use their truck. Their truck said, "Haulers and Disposers". I also rented a garage at a nearby house for $150 a month. I had the haulers load up the truck and head to the freeway. Then go a few miles and head back to the garage. The tenant got word that their stuff was going to the dump and took pictures. I had the stuff put into the garage and waited for my tenants new found attorney to contact me.

Within a week I got a letter from my tenants free attorney asking for damages for disposing of her belongings.

I asked the attorney for the location I should drop off the tenants belongings and for the cost of transportation and storage. I haven't heard back. Then my attorney gave the tenant notice of abandonment. Later I was able to dispose of the junk.

I think you better study NJ laws - blue letters, top left of this page. VA law addresses what to do in the case of a unit becoming uninhabitable. NJ probably does, too. Document everything!

This could be state specific. In NJ there is a specific protocol when tenant is evicted and leaves things behind. Owner must store it, send a letter offering 33 days for tenant to retrieve their stuff. Owner cannot hold tenant's belongings "hostage" for unpaid rent or other charges but can charge for out-of-pocket packing, moving & storage fees. These belongings become the owner's after 33 days. Owner can keep, sell, or discard then. Send the letter regular and certified to tenant's last known address. You might want to check with an attorney about this. Sample letter below. Good luck.

Dear tenant,

You left a lot of personal effects behind. If you want any of these things you have 33 days from the date of this letter to contact me and retrieve your things.

You must also pay reasonable storage and handling fees by cash or certified funds at time of pick-up. You will also need boxes, handcarts, and help to remove your belongings.

If you don't retrieve your things within 33 days, this property becomes mine and I will dispose of all of it and bill you for my time and storage fees.

This letter was sent to you via regular and certified mail, return receipt requested.
