What are the legal requirements for installing security cameras, video no audio, for the front door facing the road and driveway of a 3 apt house? Do I need to give tenants notice that are there? Post a sign on at the front door? At the moment they will be wifi until we can afford a wired. Pro's/Con's of legal issues?

In PA cameras are ok on the outside as long as you're not pointing it at your neighbors. There is no expectation of privacy outside. If you place a camera inside in a common area you need to place plenty of signage indicating video surveillance monitoring is in effect. Good luck. --67.165.xx.xx

Not sure of the legalities but I presume that as long as it's not aimed towards the insides of a unit that it should be fine especially since it's video only.

I would post a sign similar to the one required for MA multis without an on site manager. IMO interior & exterior signage stating that there are video cameras in use is a good idea. Make sure you use a camera that is decent enough to provide imagines that are easily identifiable. I've noticed that the images from a lot of cameras used for this are worthless for ID purposes. --96.237.xx.xx

One would be attached above the front entrance facing away from the building - towards the sidewalk/road. The other would be next to the parking area looking down the driveway towards the sidewalk/road. Nothing inside anywhere, not even the common areas or backyard. I find it helpful to post a large sign warning everyone that they are being recorded. When I tried to introduce a video in court to prove a neighbors son broke a front window in my apartment complex, their defense attorney said that:

it is illegal to film persons without notice.

it is illegal to film public areas.

it is illegal to film minors.

I then proved my camera was directed at areas of my property only and that I had given everyone advanced notice via my sign. My video was allowed to be viewed and proved "intent" on behalf of the minor child he intended to break the front window. The tenants daughter inside wouldn't go out on a date so we wanted to scare the family. --47.156.xx.xx

I recently had a Security company come out to one of my properties. Cameras in locations you suggested are fine. The biggest problem they have is with people destroying the cameras. My plan is to get the cameras that are built into the lights. Then I will put up fake cameras as decoys so if anyone decides to destroy the cameras they will only be destroying a $4.00 fake one. --174.199.xx.xx

Ann, the MA State Sanitation code requires owners of multi family properties to post a notice made of durable materials and no smaller than 20 square inches that lists the owner's name, address and telephone number if he or she does not live in the building or have a manager living there.

I just use my name, property address of the building & phone number. Since I have a mailbox with my name on it at each property no one has ever questioned it. I put them on the interior above the entry doors. --96.237.xx.xx

No lawyer said that. It is totally untrue.

Renion, you could point it at your neighbors if you wanted to.

You can video anyone in any public place as long as you are doing it from a place where you are allowed to be. No permission needed. You can also video anyone in and on property you own as long as it is not in a place with a reasonable expectation of privacy (bathroom, bedroom).

I have my tenants sign an acknowledgment that they are aware of the cameras and that they understand the cameras are not monitored live 24 hours a day. They are there to review after the fact only. I had read a case where a tenant who was attacked claimed they thought they were safe because there were cameras. I advise my tenants that they should use the same degree of caution they would ordinarily use as if the cameras weren’t there. --174.201.xx.xxx

Jeff you are so right! However in Los Angeles, we have kangaroo courts. By case law (even in small claims court) or rules imposed by the city, THERE ARE MANY CAMERA RESTRICTION when using the by product as evidence in a trial. --47.156.xx.xx

As a former newspaper photojournalist it IS legal to film public spaces, without notice or minors. We did it all the time. You can't film where a reasonable expectation of privacy is expected. Bathroom, walled yard, etc.

When we had apts we had cameras on the parking lots, the main entrances, and laundry room. It was an amenity. --47.216.xx.xxx
