State Specific Question About: OHIO (OH)

Tenant in my Ohio house was evicted. After he left I found out he had filed chapter 7 bankruptcy. When he left, he took all my appliances dishwasher, range and refrigerator, railings to 2nd floor and basement, front screen door,carpet in one bedroom and blower motor from furnace. He left a large dumpster full of trash in house. He also removed shower door and ran water on floors which set up mold and mildew in house. What can I do about this? Bk is not closed yet. Also left $769 water bill that water division is billing me for. --165.227.xxx.xxx

You could have this person arrested for theft but you would have to go there and swear out a warrant.

I second the going to the police department and having him arrested. As far as the bankruptcy, were you given notice as a creditor? All creditors have to get notice. You might want to talk to an attorney about that to see best way to proceed. --32.211.xxx.xxx

I don't know the police would be helpful after the recent post about stolen amenities and police saying it is a civil matter.

Anyone know what happens if you file small claims after bankruptcy is over? Then you could keep renewing the judgement till this tenant has funds in the future? --24.194.xx.xx

I took my lease with the inventory listed, my pictures and receipts for items stolen and filed a police report. I got neighbors to confirm they saw my tenant remove those items and loaded them up on a moving truck.

I then use a private instigator to locate the tenants new rental. Or I follow my x-tenant home from work. The I have my investigator see if my property is in the new rental. Look through windows, talk to neighbors, etc.

Then I call the police and have him arrested for theft.

One time I had a new stove and refrigerator, plus a window a/c go missing. My appliance supplier writes down on my invoices the model and serial number of the appliance and the location of the drop off and install.

With the invoice from my appliance provider, I was able to get the tenant arrested and my items returned. --47.156.xx.xx

My experience with bankruptcy is that you will never see that money, you aren't allowed to ask for it, and they never have to pay you.

Although, I have one going through bankruptcy right now that is paying the rent early every month and intends to stay. I'm surprised at the bankruptcy because her credit wasn't bad enough to file over, but she just got married and maybe the husband doesn't want to take on her debt?

Good tenant, so-so credit gets a different result in bankruptcy than a bad tenant with bad credit? You didn't find anything negative about this tenant before you let them in, OP? --98.146.xxx.xxx

Once they have filed, you are not permitted to pursue them...the bankruptcy affords them "protection".

I had a similar issue except my tenant left peacefully when she could not pay, and did not destroy the property. I filed as a claimant with the court (did not talk to her at all...dealt with the bankrupcty court only). A YEAR LATER, I got a check for 2/3 of what she owed...it was my portion of her assets....I was her largest claim!

When did he file? If before moving, you've got a chance. The only thing the BK7 discharges are debts that existed ON THE DAY HE FILED. If he moved after filing, then the related damages occurred AFTER filing and are not wiped out. --206.225.xxx.xx

Talk with a lawyer, but I'd consider filing criminal charges then sue him for criminal damages. Surely that's different from being a creditor. --108.69.xxx.xxx
