There is very heavy tenant guest leaning on the deck and broke the deck and fell. The deck is about 4 or 5 step high.

Can we add in the lease to prohibit people lean on the deck?

It is the deck to access the side door less than half level (split level). Very small deck, Some one about 450lb fell. Do most people lean their back on the deck like that or not?

So this is a guest of the resident. You did not invite him, feed hom or push him or invite them to lean on deck or invite him to deck. You as landlord received a phone call that this occured? Is the person hurt? Ambulance called? This person has health care? At least board up the area so it is safe. If the door is for fire exit consider that if disallowing exit. Replace the deck it is different to get anyone to repair decks cause of liability. Secure area so no one else falls. Hope the person is ok. Plenty, I did not know about the accident until about 1 year after it happened and the guest's attorney sent me the paper. The tenant did not know about the law suit and continued to have the guest to come over many times after. He did not go to hospital the same day, but went hospital maybe next day.

He jumped to someone's pool, get hurt and went to hospital the day prior to falling on the deck.

He went back to work and fell from work after monthes off from work after the accident.

Sounds like an insurance scammer to me.

Provided your deck is built to code, railings proper height 36" or 42", railings able to withstand 2oo# of lateral force, etc then you are fine. The only way you could restrict people from using the deck would be to remove it. --96.237.xx.xx

By your latest clarification, this could be a lawyer motivated and pursued case.

Call your liability insurance carrier for help. They have a legal dept that handles law suits like this.

Regardless, don't take this case lightly and fight it. Can this man prove that he actually fell as he said? Are there witnesses? Are they reliable?

The load test means what is says, be sure to cross examine tenant under oath, if they threw away the old wood without contacting you this accident didn't happen - destructive behavior occurred and you will bill the tenant in the next rent cycle, need toxicology report on alleged victim to address intoxicated criminal damaging charges you are countersueing for.

I'm not sure where you found the 125 lbs of force but OSHA requires a rail to resist 200 lbs of lateral force. Difficult to exceed 200 lbs lateral force even if the person is 450 lbs. Either the railing wasn't strong enough to resist 200 lbs lateral force or your tenant's guest got a running start at the rail. No one is going to admit running at the rail so you'll need to prove it was strong enough to begin with. As you no longer have the parts you are out of luck.

Not good idea to put in the lease not to lean on railing. Provides ammunition that you knew ahead of time your railing was weak.

You need to send the lawsuit paper to your insurance agent immediately to let them handle it.

ED, I found from two website. They have different lb.

"The IRC requires that the railing be able to resist a 200-pound concentrated load applied along the top in any direction, while some local codes still in effect specify a smaller load of 20 pounds per linear foot.

After an above-ground swimming pool was removed, the owners continued to use the deck in our photo (left). Deer netting was installed across the open edge of the deck - and it worked fine until someone fell thorough it. The torn remains of the deer netting can be seen on the left side of this photograph.

Continuing from from Best Practices Guide to Residential Construction:

Under the IRC, the infill or balusters must resist a concentrated horizontal load of 50 pounds applied to a square foot area.

The baluster requirement is easily met with standard fastening techniques, but meeting the IRC guardrail requirement is difficult without adding steel hardware.

The majority of residential decks, which rely on notched posts lag-screwed into the band joist, do not meet the 200-pound requirement."

I think the sign would have no effect, ever hear of a parking ticket - there was a hungry parking meter or someone ignored the no parking sign, a speeding ticket is issued for exceeding the posted speed limit - speed limit sign is hanging somewhere in that area, did you ever see a car wreck? Someone drove on thru a stop sign, yeah one of those red 8 sided things that have the word stop horizontally spelled out.

I added a bathroom to a clients large home. A new master suit with walk-in closets and a master bathroom.

I asked the Husband and Wife what their combined weight was, because I built them a custom shower with steam and a seat. I never met their adult children.

So when the addition was completed, the couple went on a trip. The husbands son from his first marriage came with his wife and took a steam shower and made out on the step. He was 450 pounds and his wife was 650 pounds. The step didn't hold.

The owners of the house combined weight was only 300 pounds. The seat was designed to hold 800 pounds, not 1100 pounds of moving weight. They son and his wife got injured. They wanted to sue me.

All I was required to do was to rebuild the shower seat. Now able to hold $3000 pounds. A large safety net. --47.156.xx.xx

I agree with Ed...railing should withstand 200 lb horizontal load, but this is not easily measured. It's more in the design and build of the deck. As a home inspector, I'd say 90% of the decks I looked at were not built anywhere near the proper "code". There are so many details that must be done correctly. I'd get it built right, tell the contractor you expect them to certify that it's built to code. If you can show it was built right, then them falling would be due to excessive force or some other issue on their part. --99.92.xxx.xxx
