Hello,

I had a tenant threaten the life of another tenant. The one threatened filed a police report. How does this typically work? The threatened tenant does not want to return to the apt since the other tenant is there.

Will I have to compensate the threatened tenant for finding other living arrangements?

Can I have the tenant who did the threatening removed?

Can the threatened tenant break the lease and leave?

Are these tenants roommates or do they each have separate apartments? If they are roommates why can't the threatened roommate just get a restraining order against the offending roommate?

Yeah, steer clear of that mess. Besides, unless the tenant admitted to threatening the other, it’s only an allegation at this point. What if you jumped through hoops dealing with these tenants only to find out later on that it didn’t really happen or the accused was found not guilty? --174.201.x.xxx

Maybe suggest the victim get a restraining order? This would force the offender to move.

"I could kill you" because someone didn't clean up the kitchen yet again is very different than a gun pointed at someone's head.

Police will deal with it or not as the situation requires.

I cannot imagine what law would require you in any state to compensate a tenant who wants to leave. If it is deemed domestic violence (legally, not just the tenant babbling) there are laws (at least in Pennsylvania) detailing breaking the lease. --72.70.xxx.xxx

When one tenant has a problem with someone or a neighbor, you should keep out of it and allow them to either work it out between themselves of use the police to help resolve matters.

When two or more tenants have the same problem with someone or neighbor, then a landlord is supposed to step in and try to resolve things.

Neighbors on three sides of one of my apartment buildings likes to throw parties all night long every month. So most weekends several of my side or rear tenants won't be able to sleep.

I first talked with the neighbors making the noise. They thought I was a "crazy jerk" and kept up the noise. I then talked with the managers then the owners. None of them would curb their tenants behavior.

My next step was to contact the police, noise abatement department and local consul-man.

None of my tenants can say I did nothing. But I requested each tenant to keep a log of noise. Write it down on their calendar and call the police -- front desk or dispatch. I gave them the numbers. So when a tenant broke the lease and moved owing rent, I had proof they did nothing to help resolve things and were liable for past rent and loss of my income unit their unit was re-rented. --47.156.xx.xx

Been there, done that...... good times!

Let the tenant know that if someone is threatening them, they need to call the police- not their LL. ( Just like if the house was on fire they should call the fire dept- not you).

The real fun starts when one tenant has a RO and isn't allowed to live in their own apartment. People don't like to pay rent on space they are legally barred from. --71.10.xxx.xxx
