Message:

A chunk of ice fell from the roof of my duplex today and damaged a tenant's car.

Maine has been in the deep-freeze for over a month, but we got our first thaw yesterday--the same day that my hired crew did snow removal / salt & sand application for this roof.

Who is responsible for the damage to my tenant's car?

P.S. The MAIN thing is that no one was hurt ! Need to examine this issue going forward, but for now I just need to figure out how to proceed regarding the tenant's car. --74.78.xxx.xxx

No one responsible. Ice falls from trees, power lines and buildings all the time. Tell tenant to contact their insurance company. --23.121.xx.xxx

KH,

Yes, THEIR auto insurance. Same as hail, flooding...Unless your crew caused it.

Thank you for all your responses. And it happened 24 hours after my crew cleared the roof. --74.78.xxx.xxx

Message:

Their auto insurance covers it, unless it happened while your crew was up on the roof and your maintenance people dropped the ice on the car while they were up there working.

If the work crew did it, their liability insurance should cover it... you do hire licensed and bonded contractors, right? --98.146.xxx.xxx

Yes, my crew is licensed and bonded. (But you're right that it didn't happen while the crew was up there.) --74.78.xxx.xxx

Was the car running?

If the car was parked, go through renters insurance. If the car was idling or moving - auto insurance. No sense jacking up someone elses car insurance rates with a claim that can be covered elsewhere --72.23.xxx.xx
