State Specific Question About: CALIFORNIA (CA)

An apartment property has two entrances from one street to the other. People who knows might use it as a short cut. Starting this year, a school bus also come in from one entrance and pick up two special needed kids who are waiting at the other end of entrance to board the bus. These kids are not our tenants. It takes a while for two kids to board the bus, according to tenants who are waiting in line to get out of property in the morning.

The neighbor property has one entrance, so bus take our property driveway for easy access.

Do I talk to the bus driver not to drive through the private property driveway and not to use our property as a pick up location? Will I get in trouble? We don't want to get in trouble with people who have disabilities.

Talk to the bus driver and to the company that operates the bus.

Point out that, if he continues to use YOUR driveway, then you will be forced to put up a gate with some kind of security code or key, or a driveway device that punctures tires.

Check your deed for any easements or the subdivision for any easements or Right-of-Ways.

Cars weight X amount.

HOWEVER

BUSES weight a lot more than cars therefore the added impact to your driveway could become a problem.

Of course you have moving trucks that enter your driveway however they are not doing this twice a day, five days a week.

Talk to the manager of the school bus company.

Focus on if there is no ROW or easement focus on the fact that the bus driver must find an alternative route due to the fact its a private drive and NOT a thru street --99.56.xx.xx

First, post "no trespassing - private property" signs.

Then talk to the Bus company's boss or person in charge. Tell him/her that this practice can't continue and his drivers have to find other ways to pick up and drop off their student(s).

If they don't respond in a positive way, install gates. Don't let then run the show. --99.59.x.xxx

We are talking about vans or actual buses? Either way, it is possible the driver doesn't know that they can't pick up there. I would talk to the company as it is possible the driver was told by the parent where to pick up. --73.230.xx.xx

It's a mid-size school bus, bigger than a van. One kid is on a wheelchair. Manager said the bus used to wait on the street, but it started to drive through the property this year. Manager will try to talk to the parents and bus driver tomorrow morning.

The driveway is hard for two cars to pass each other. It is a one-way direction, so cars can't go out through the other exit.

From what I read, it sounded to me like the bus IS going out the other way. But the cars can't? Or are they just doing the right thing by not going out the other way and the bus is going the wrong way?

One of my apartment building is next to an AID building in West Hollywood. At least 50% of those tenants don't have AID but do have the Lazy syndrome -- taking tax dollars and then renting out the rooms designed for their boyfreind and care givers making lots of money. Fraud.

The building next door has shuttle buses taking the real patients to doctors. The others who don't have AIDS also use the bus to drop them off at the market, local park, etc.

These buses pull onto my property and block my tenants from exiting and entering the building. I've reported this to the Sheriff, City Government to no avail. So I had to take these matter into my own hands.

With my 10 ton flat bed truck, I blocked in an City Transportation Bus with patients. When the passengers and bus company called the sheriff, they got an immediate response. Within minutes 5 low enforcement vehicles showed up. They didn't care what my story was and contacted Howard Summers towing and had a large 50 ton tow truck show up to move me.

On the side of my truck I had signs out, "Toxic Substances". I am a contractor and licensed to haul/dispose of hazardous waste. I told the tow truck driver that since he's not licensed to transport toxic substances, the fine, if he decides to two me is around $100,000. He confirmed with his dispatch that the fines are hugs. I had metal barrels in the back of my 18 foot long bed filled with chemicals and labeled accordingly. It was colored H20, water. But we didn't need to tell them this.

Bus driver used to come pick the kids up down at our end of the dead end street as a courtesy to the kids so they wouldn't have walk up the road. However the only way to turn around was on our property, plus the bus was really doing damage to the grounds when it was muddy.

Final straw was when the bus woke up one of my tenants to move their car from its parking space so they could turn around!

Called the County. Bus not allowed to drive on private property. Poor kids now have to walk to the other end of the road. Usually their parents drive them... --50.82.xxx.xx

I ended up having the City bus towed off of my property and moved to an Official Police Garage (OPG) located 30 miles away, downtown L.A. This private towing company wouldn't release the vehicle, to anyone, until they got they towing fee -- something over $500.

Since no one could move my truck and the City sent another bus to transfer the patients and take them to their appointments. When no one was looking, several hours later is when I moved my truck so it could be towed.

The City took me to court trying to squeeze money from me. But the Judge saw the years of abuse and inconvenience to my tenants.

I also had another situation where a car plowed into a fire hydrant and until the water could be turned off the people in the car couldn't be treated. I managed to park my plumbing van in a Bus Zone and turn off the water. A parking attended ticked my van because I parked momentarily in a bus zone. I couldn't win that case so why should a Bus get away with blocking my tenants everyday for 2 years? --47.156.xx.xx
