Well this is a new one for me. I’ve tried looking up past questions and online searches but the situation is: I just signed a year lease with my new tenants on 1/12. The girl just messaged me today wanting to know if I could remove her boyfriend from the lease because they broke up and “things went south” I asked if he wanted out of the lease also to which she said no. They lived together a year at the house before mine and I talked to the landlord who told me he never had any problems.

I’m pretty sure I can’t take his name off just because she wants, especially since he isn’t wanting that. She is the only one of the 2 that works and makes 5 times the rent so that isn’t an issue. Because I almost had an issue with this a year ago I had put a clause in my lease that each tenant is responsible for rent the whole rent period even if one moves out. If one wants to move out once lease is month to month, both must agree to it. It’s only been literally 6 days... Advice ?

If bf is released from ease, he no longer has right to live there.

Thats all that gf has to gain from bf's release.

You have nothing to gain from release.

Tell them that they rented the dwelling together, now its up to them to settle their mutual living arrangement by themselves.

Had the adult son of a tenant move in with mom - he was never on lease. Mom moved out and he stayed - police said since he had established residency, I could not have him removed, but had to evict. Tried everything short of eviction and finally had to expedite and save eviction costs by giving cash for keys - one of the most annoying acts a landlord has to perform. I told her yesterday, I can’t release him unless it’s mutual on both of them (which it’s not) I said I’m sorry but if it turns into domestic you can get a restraining order... hopefully that’s not the case since they have a 3 year old with them. Well they are young 18 & 20 so I’m sure they’ll be back together in a week. --173.26.xx.xxx

Do you have a lease termination clause in your lease? I recommend getting one if you don't. Mine says the lease can be terminated with payment of two months rent. Were I in your situation, I'd tell boyfriend he signed a legal contract and if he wants out of it, he pays two months rent. Otherwise, he's legally responsible (joint and several, ie, individual liability) for the entire lease and all of its terms until the lease ends - even if he doesn't live there anymore.

I would not be in your situation because I don't rent to shackups unless both meet ALL rental qualifications, including income, past rental history, past employment history, etc. and he does not. I would have considered his inability to qualify as a blessing because regardless of what prior landlord said, two shackups with a baby is not a good tenant for about a million reasons. --144.191.xxx.x

No I don’t have that in my lease yet, I’ve read it her but been undecided. But in this situation it wouldn’t have helped anyway. Dive he’s unemployed he wouldn’t have 2 months rent to get out of the lease. Maybe the girlfriend would pay it but I don’t think so because he would have to be willing to move out which he isn’t. --173.26.xx.xxx
