State Specific Question About: NORTH CAROLINA (NC)

I have a renter that has 8 vehicles parked on the property. One of them is an RV which belongs to her father-in-law. There is an electrical cord plugged up to the house. Renters pay rent on time and all is good there. But neighbors have complained that they are also keeping a pig. Between the RV and the pig, I am just at a loss as to what to do. I am studying the contract which I thought was sufficient to cover all problems. But I never thought anyone would park an RV in the yard, along with other vehicles, and also keep a pig. --64.53.xx.xxx

Any city ordinances, or is this a rural property-- or a very urban one? In my town, for example, pig-keeping inside the city limits is forbidden.

If someone is living in the RV-- presumably someone is, because it has electricity hooked up to it-- you have an unauthorized tenant living on your property.

Presumably the property is zoned for single occupancy. So the RV is being turned into an unauthorized ADU of sorts.

I have a bit in my lease that says all vehicles must be in working condition-- no junkers. So if all eight vehicles are operable, then there's the question of "are they parking in the yard" and "are they going to crush the plumbing lines". But if six of the eight vehicles are for parts or projects-- yeah, that's a no go. --96.46.xxx.xx

Haha! When I saw your subject line I HAD to read it! Sounds like the set up to a good joke.

A good lease will include verbiage about only residents named on the lease, no guests longer than 14 days in 365 days, only vehicles listed on the lease or appl...

How long has the RV been there? Could it be a holiday guest?

My town has a law against living in an RV in town. Ask your local code enforcement.

Basically I make a copy of that lease page (every page has their initials on it), highlight the clause, write a note in the margin “Joe, please remove the RV and extra cars within 7 days. I’ll check back on the 7th day. Thanks!”

This is LLing 101. No sweat, just be sure to follow up.

It’s also time for an in home inspection, looking for more violations and extra people.

In my town a resident is allowed 1 pet pig. More pigs is considered agricultural.

I had a tenant that was down on their luck. They parked a large RV on the backyard lawn. Things weren't so bad until the wife and husband split up and he moved into the RV, making noise all night long.

I gave them a notice to perform or quit. The music continued. I had to evict. The husband didn't realize that after he was ejected by the Sheriff, the RV would be a perfect place to live. Now he lives in his car in the back of a local shopping center. --47.156.xx.xx

Thank you so much for your responses. The property in question is a very rural area in North Carolina. I have good communication with the renter. I spoke with her at length last night, and also spoke with her husband (he is not on the contract) Hopefully, the RV and the pig will be gone before long, as well as all the extra vehicles which, according to my renter, are the responsibility of her father-in-law

If I had that conversation with her at some point I would say it looks we are on the same page here and when she agrees I would then say ok it looks like you need me to be the bad guy is that correct? when she says yes I would then hand her my lease violation form and explain to her the consequences if not complied with,she can then show him what the mean landlord said and she is off the hook and I hopefully get compliance --72.231.xxx.xxx

This is Tenant Logic 101: tell the LL someone besides me is responsible. Nope. Tenant is responsible. Tenant signed the lease. Anyone/anything on the property is the TENANT's responsibility, as is anything they bring onto the premises. Don't let them play games with you.

8 cars + an RV is nuts.

I know you spoke to them. Tenants tend to ignore the spoken word. Send written notice. That tells them you're serious and gives you a paper trail if it ends up in court. With that many vehicles, I'm guessing this is going to end up in court.

If your lease doesn't address the # of vehicles and occupants, then state this is your "official policy." You rented the premises to the current tenant with their current vehicles. You did not rent it to their entire family + a used car lot. Make your expectations clear and if they refuse to follow them then it's time to move them along elsewhere.

For the future, be sure to have all persons age 18 and older sign the lease. There is no benefit to having the hubby not on the lease. More signers = more folks to collect from later. --173.20.xxx.xxx

If it's very rural then I would leave it alone except to try and help the neighbors. I believe one pig is allowed here in my very suburban neighborhood. In fact there was one two doors down from my SFH. No problem except that the people who owned it were new to the Northeast and did not know about cleaning up after a pet's poo. So I was finding odd greenish dog poos on my lawn and getting a stick and flipping them into the street. Then one day I was walking my actual dog and she pooped right on the pig owner's lawn. So I bent down with a little bag and scooped it. Well the pig owner was outside and said, you don't have to do that and I explained about the laws. No more pig poo after that. I hope your pig problem is a small one. When I flipped the pig poo into the street it broke up a lot and the high school students walked down the center of the street to go home and I watched their expressions of disgust. I had a lot of trouble with them trashing my political signs so that evened it out. --73.248.xxx.xxx

Pig Roast for Christmas!!! Chestnuts roasting on an open fire! Helps to add flavor to Christmas dinner.

Kim of NC, You did run a credit and criminal check on the wife. HOWEVER BIG mistake not to run credit and criminal check on husband too. PLUS did you do an in home visit checking on their living conditions before signing the lease with them.

SURE go ahead ignore it then you will have a yard full of cars and when they move damaged grass and several junk cars will be your headache to deal with.

Immediately post notice to remove excess vehicles that is damaging grass. Remove RV from premises. Remove pig from premises and refer to lease for each of the breaches of the lease. If not completed in 7 days eviction notice will be posted.

NO need to talk to tenants they will make EXCUSES AS she did. STOP talking to tenant and take immediate action with posted notice. The paper trail and pictures are important to have when eviction does occur and its time for court.

You guys are so great, and so helpful. All these comments and suggestions have made me think hard. My lease addresses proper registration of vehicles, also the make, model, and license number of vehicles to be kept on the property. It does not address or prohibit additional vehicles after the lease commences. I have work to do on my lease. This reminds me much of raising children. My own four kids did stuff that I never, ever thought to forbid in advance. The variety of what tenants can come up with cannot be completely anticipated. This experience has taught me much. --64.53.xx.xxx
