I do a standard check with PA Courts before I agree to show a room or apartment. Did one today and came back with a very recent LL/Tenant case on an applicant. Sometimes I'll confront them with what I uncovered. This person didn't lie, but I generally don't ask roomers about evictions and evictions don't prevent me from renting to them mainly because I can self evict if they don't pay or run afoul of my rules. If it was one of my apartments, he'd be a no go. He has a decent job with a local financial services firm and will probably be a longer term tenant. Looking at the case file, I see that the disposition was to grant possession if money judgement was not satisfied. Case disposition was 12/4/18, so set out was either today or coming shortly. I can't remember if they count weekends. Anyway, I text him a link to the case and ask if this is his eviction case. It was an open ended question. Here's how he responded:

"It's not an eviction case, but she is trying to make one out of it. She has had several opportunities over the past month to receive payment from a church willing to help me by covering the rent still wants to evict. She didn't cash one check I gave her because she "is mad." She even asked the magistrate if she could refuse payment. It's vindictive and discriminatory."

His rent at his old place was $ 595 a month. His rent with me will be $ 150 a week, which is about $ 650 a month. I will require that he pre-pay his last week and will let him know in no uncertain terms that he faces immediate lockout if he doesn't pay the rent. I'm not sure if he's renting an apartment at that rent level as that's well below market for this area. He may be renting a room in an unlicensed place, hence the eviction proceedings. I'll find out tomorrow.

No. Several reasons.

1) It WAS an eviction case. He didn't see it that way, but the bottom line is he failed to pay rent as agreed and did other things to make the land lord "mad".

2) Blamed his inability to keep his word on others. He could have moved out without being filed on in court. He chose not to.

3) I don't cash checks either. Bring me MONEY, not check.

So NO-GO for me. I understand people make mistakes, but they can also own up to what they did wrong and make things right after the fact. Blaming others and whining about discrimination tells me this person do not accept responsibility for failing to abide by his lease.

I would pass him by unless you think you can handle whatever else he did to make a female landlord mad. When they write a check and the LL doesn't want to accept it you know there is something else going on. He might be on some kind of meds and if he goes off of them he could be trouble with yelling and odd behaviors. --73.248.xxx.xxx

That's a no for me also. What others said plus if he wants a church to pay his rent, that shows lack of ability to handle money. He will continue this as long as some church or other organization believes the lies and pays rent for him.

Expect his friends to visit on a regular basis overnight.

There are two risks I have with this guy and neither one is related to not getting paid. Those risks are:

1) A short-term rental because I lock him out due to non payment or non compliance with the house rules/rental agreement terms or even if I happen to wake up and feel capricious that day. Rent is collected weekly in advance in cash. I don't accept third party checks from churches or from tenants. It's pay and stay or immediate eviction/lockout.

2. The hassle factor if he has a entitlement attitude and has behavioral issues. This too is tied to the risk of a short-term rental. I want folks to stay at least 3 months.

Either way, he's on the street. My risk is the hassle of dealing with either. The chances of not getting paid are remote. The chances of a short-term vacancy are higher. If this were one of my apartments, I wouldn't consider. --209.122.xx.xxx

I suspect lying.

And I like what WMH says if he would not leave voluntarily and forced the LL to go to court I’m not interested.

Can’t keep up rent now.

Plenty of other LLs will take him.

An eviction by itself will not stop me from renting to them. There are plenty of times when a couple is no longer a couple and the eviction will name both persons even if only one person was notified of the hearing.

If you do have an eviction on your record, I will not rent to you if there is an outstanding balance in the court records. So if a tenant screwed up but ended up paying what was owed - they are very trainable. --72.23.xxx.xx

An eviction case that is filed as an eviction case in PA will be numbered in the following manner: LT- 01234- 2018 for landlord tenant case number 01234 of 2018.

Under the status of the case there are two lines you need to read:

1) grant possession? Y/N (unless terms were listed in the complaint, the answer should be NO.)

2) Grant possession if money judgement is not paid? (this would be a payment issue only and typically its YES)
