You would have to read the lease and see.

Otherwise tenants only pay for damages or something that is NOT normal wear & tear.

I’m not sure what Brad’s lease costs, but it sounds incredibly thorough. You sound like you are recreating the wheel and I speak from experience that you will miss things. I paid a lawyer to look at one I cobbled together initially. Never realized I missed a no smoking clause. After hearing a lawyer in my landlord group speak at monthly meetings I made the decision to pay him to design my lease since he would be my choice to defend it. It was an expensive investment but I have used it several times to send someone packing prior to a formal eviction. You might consider investing in Brad’s lease. Then you could customize or remove certain parts that might not apply. It is easier to cut parts than try to build from scratch. --24.61.xxx.xx

A few thoughts:

1) If you can get a good lease that's already written, go for it. There's no sense in completely reinventing the wheel. I've seen parts of Brad's and talked to those who use it. Only reason I haven't bought it is I already have one that incorporates many (most?) of the same principles that has been reviewed by my attorney and tested in my location, so I know it works.

2) Don't worry about myob's straight-forwardness....his point is valid. Maybe post-coffee it will soften a bit. :-)

3) To answer you specific question, in my lease the tenant pays for everything that I DON'T agree to pay for.

Appliances: Provided for tenant's use as a courtesy, but we do not warranty them or guarantee operation. TENANT is welcome to bring their own. For good tenants, I will fix them as a courtesy, but that is NOT in the lease: it is at my discretion. I rent Class C homes. Class A or B will expect appliances and service on them when they fail most likely. NE[PA] has a "service plan" he sells to the tenants if they want him to repair appliances. I've thought about adding that to generate extra income.

Utilities: Tenant's pay for everything. I still have a couple on master water meter, but that's it. As soon as I can find an inexpensive plumber I'll have them separated and make each tenant responsible. Tenants waste the stuff you pay for more than the stuff they pay for.

Trash: Tenant pays. If they fail to get trash service within 5 business days, I set it up and add the cost to the rent due.

Lawn: Tenant mows, unless it's a -plex, and in that case my guy mows. Tenant provides their own yard care equipment. I don't want any nutty judge ruling them my employees. --173.20.xxx.xxx

Look up the sites above and they will help you understand what is allowed or not allowed in TN. In NH, our laws are accessed by the state general court website. I always find the tenant’s rights website to be a great place to find I formation because it is written simply... your landlord can do this... your landlord can’t do this... with out the legal jargon.

find a landlord/investment group in your area or somewhere in your state. they should have a lease with clauses specific to YOUR state.... In Pennsylvania, I know of three large organizations, all with leases. I'm sure there are a few other organizations here also.

These leases contain language specific to our state such as a waiver of notice clause, Act 129 and late fees (I see a lot of daily late fees mentioned on here - in Pennsylvania, the magistrate will not allow that but only up to 10%). I can all but guarantee a generic internet lease or a Staples lease does not contain these important clauses. --72.70.xxx.xxx

Your state law will prevail if your lease term that you are citing as tenant violation is contrary to your State Law.

This leads offered here on this site are not likely to be substantially contrary to your state law......issues such as who must serve notice, how many days until you can file for eviction, grace periods and the like are the areas that I would edit.

The bigger point is to get a lease that will make you $$. Auto renewal increases, pet fees, cleaning charges, ACH payments. Voluntary wage assignment. I'll bet that your attorney won't include any of these items. --72.172.xxx.xx

I see sooo many posts here that could suffer from Wimpy-Lease-Itis and could have been avoided or solved with a great lease.

The first job of an atty is to protect his/her reputation. They do not want to appear aggressive or one sided.

Their second job is to create billable hours. A good lease means less need for an atty so fewer billable hours. I have heard attys say "Don't worry about your lease - I will help you deal with any problems that come up."

I collect leases and study them to "borrow" ideas. Plus each time I hit a problem or get a surprise (41 years, 350+ evictions, 2,000 court appearances) I add a clause to my lease to protect me should this EVER happen again.

I include clauses and policies which CREATE income for me as Sisco pointed out.

EVERYTHING I want to the resident and the judge to know is in writing, NOTHING assumed or left to chance.

Paper is cheap. Cheaper than ANY management problem.

I love it 6x6 that you are are so willing to learn. You need to be the absolute expert on the lease that you use. If you are not the expert, you will not be able to train your customers.

You should never be asking someone else what is in your lease unless its your attorney explaining it to you.

If you are asking if it is typical for a resident to pay for repairs to appliances, I would say it largely depends on the nature of the damage. If it is normal wear and tear, it is typically the LL. If it is beyond wear and tear, it should be the resident --72.23.xxx.xx

6x6 - just remember that whatever you do you that the lease is considered "living" in the sense that as you learn things here or learn things as you go from your tenants, etc. that you MODIFY your lease for the future.

Some things can be an addendum where other things should just be in the lease itself.

Brads lease is a great starting point. Something I found useful when I started that Vee suggested is to print out a copy of your state, county and city landlord tenant laws ( there's a link to most states here on the Mr Landlord page that our host Jeffrey has provided) or bookmark them in your browser. After you tweak Brads lease to fit your needs - don't remove too much until you run it up against the state, county and city laws. When you do this you'll learn a lot and may not need a lawyer.
