We leased a 2 car garage from an elderly widow for 12 months to store household items until new place is ready. The lease says to pay 1st of month $200 cash to the name on the lease (homeownwer) .All went well for the 1st 6mos, then the lady answering the door says she has power of attorney and she accepted dec rent but says we now have to mail a check to her son out of state. The son sent us a copy pf power of attorney and wants the check mailed to him in Mich! We were not allowed to speak to the homeowner as her sister and husband moved in. We plan on returning to the property with cash as our lease spells out and the sister can send the money to her son . The son says he will evict us if we do not mail him a check. We are sure if mailed, the rent could be late and do not want to risk it. HELP !!!! --47.138.xx.xx

Get another storage unit.

If you stay, I wouldn't pay cash anymore in this case so you have a record. Try to get something NEW in writing as to where the rent goes, signed by everyone so it's nots a he said/she said situation. --50.32.xxx.xx

Seems a regular mini storage facility would be less expensive. Also, they are likely safer for your stuff. These people could just take your stuff and deny you ever had anything there. What do you have for proof? Receipts? Nothing???

Wanting cash, they are likely scamming the govt and not paying taxes. If they are willing to rip off the govt, they will be willing to rip you off too.

They're changing the rules on you midway through.

Your agreement is with the "elderly widow", but "the lady answering the door" seems to be the elderly widow's sister, who has moved in with her?

Your agreement isn't with anyone besides the elderly widow, not the elderly widow's sister, or the elderly widow's nephew, or anything else. ("Her" son is the sister's son, not the widow's son, right?)

You've got this in writing, right? And it's been signed by everyone? So the general rule is that an agreement in writing can only be amended by an instrument in writing that's signed by all parties.

If you don't have it in writing, I'd go rent myself a storage POD ASAP and cut my ties with these people. Yeah, my attorney could probably make short work of them if they made a false move--- but sometimes, getting out of a toxic situation is better, especially when you've got nonparties throwing around talk about "eviction". --96.46.xxx.xx

Stop the insanity! This is easy. Contact whomever has power of attorney. Ask him/her to send you a lease amendment that addresses how to remit rent. Then follow the instructions.

It's likely the original landlady is incapable of managing her affairs. In cases like this, it is normal for a family member to take over. Whomever has power of attorney has legal authority to manage for her. Don't be a b*tt head and try to say they can't change the terms of the lease without your consent. Just get the change in writing and buy some stamps. Don't make this harder than it has to be for you or the LL's caretaker. --68.156.xx.xx

Her family is either afraid you are not paying her or that she is losing the money. She may be forgetting that you paid and is telling them you owe her. Make verbal contact with the person to whom you will be mailing the check and ask questions. You can also mail the check as you have been requested and you have seen the power of attorney. Send it certified mail, return receipt requested. YOu can always cancel the check at the bank if things go bad. If you are worried about it getting there in time make it go priority mail too.

How is this any different from a landlord changing his mailing address? I'd expect my tenants to send to my new address. Why not the same in this situation?

Definitely pay by check or get a receipt so you have proof. Ask if you can Venmo or PayPal amount, or clear now if you're worried about being late. Or you could just pay on time or pay 1 month ahead? But that's just me with my landlord hat on. --108.69.xxx.xxx
