On the news this morning. Spokane is drafting legislation for a domestic violence registry. I am going to assume it is for convictions, not accusations.
I'm thinking that this would be a great asset for landlords. Myself, I don't want domestic violence in my rentals. It would be nice to have it easy to look up. --174.216.x.xxx |

I'm not sure how I feel about this. A domestic battery conviction could be as simple as one partner striking or shoving another while they are both drunk. That doesn't make it right and they should be punished but I don't know if someone deserves the scarlet letter of being in a registry for that. --72.188.xxx.xxx |

J/FL, at least around here, if a couple is involved in an altercation they are BOTH charged with assault, although he gets charged with a higher crime of "assault on a female."
I've gone to a few seminars on this with law enforcement, and the police said 90% of the DV calls come from the same darn people, over and over and over again.
It takes a LOT to actually convict someone of DV. MOST DV cases get dropped. So if there is an actual conviction, I certainly want to know. I don't want that kind of "Drama in the Driveway" on my properties. I don't want the police called to my property over and over, we don't want to be THAT house in the neighborhood. --50.82.xxx.xx |

I was on the volunteer EMS for 22 years. In domestic violence situations (and I have seen and heard them all), it usually boils down to alcohol or drugs.

I can understand why an LL would want to take advantage of this new registry, if it gets created. However, I wonder what purpose Spokane is creating this for. The sex offender registry is at least ostensibly so that those sex offenders can be tracked so that they're not living near a school, and have a fixed address. The DV people don't live under those type of restrictions usually, and the crime is sometimes only a misdemeanor depending on what happened. We have that law in Florida too. But if someone tries to buy a gun the conviction should show up during the background check. Like David said this registry seems like a duplication of something that already exists in the public records. --72.188.xxx.xxx |

I can't speak to your state, but over here - we have access to police records already. If someone is charged with a violent crime, it should be part of the police record already.

I will say right off - I've not heard any new development on this for at least six months. That said....
There was talk going around in Indiana about renting to convicted felons; that landlords could not simply disqualify on the basis of conviction.
Being the typical pain in the rear, I asked the pointed question: Can I have the "approved list" of crimes that are okay to discriminate against, vs those that are not?
Does the law say I should rent to the wife beater, but be within my rights to exclude a murderer? What about a thief?
Of course, I get no straight answer.
If memory serves (and I'm getting old) this was coming down from HUD. I could be wrong.

What HUD says is a landlord cannot have an automatic rejection policy for convictions. Some do - any crime, you are disqualified. But now HUD says we are required to consider each case on its own merits.
I reject those who were convicted of crimes against people or property out of hand. Violent crimes. I don't want to rent to someone who is comfortable stealing, fighting, etc.
But I'll consider a drug conviction - depending on the circumstances. --50.82.xxx.xx |
