I have a tenant that is almost 2 months behind due to stroke (CVA). a family member is @ the house constantly to help take care of her. the family member said she would pay rent to catch her up if I added her to the lease as "head of household." I've given a 3day notice already & very close to filing for eviction. it doesn't make sense to me why she would want to be added to the lease b4 she helps her get caught up. if I file for the eviction then her name will be on it also. is there some kind of trick associated with this? --65.24.xx.xxx

Looks like a tax gimmick to me. Head of household has different exemptions.

However, it might have something to do with filing for welfare, charity or other programs where someone else pays the money.

Turner, in your previous post you stated that they are paying but slow. IMO it would not be in your best interest to continue to work with them. It will only get worse. Better to cut ties now than to drag it out and still have an eviction to deal with. As Richard said, the caregiver is looking for a tax loophole and wants to get that buttoned up by the end of the year. That has nothing to do with their ability to pay the rent. --98.17.xx.xxx

In good faith "I can not add you to a lease that is in arrears". Get caught up by Friday or eviction will start.

This person will need to have an app run on her so start there.

As a renter there is no head of household problem for you. Maybe she would lie to someone but that's her problem.

No matter who's on the lease the defendant should always be name on lease and ALL OTHERS-- that covers anyone who answers the door when the sheriff knocks serving warrants.

Can I say -- don't give an ultimatum unless you FULLY INTENT TO FOLLOW THROUGH ON IT. You gave 3 day-- follow thru or the Emperor will have no cloths.

The trick as you put it is for the LL to get the rent-- so as to be able to pay his bills. --99.103.xxx.xxx

I would ask more questions about "head of household" designation and if I liked the answer and the income data on this new person I would do it. Talk before you leap. Frankly, I don't give a hoot what kind of title my tenant uses. Whether she is head of household or toenail of household, she is not any more or less liable for the lease because of her title.

I expect the the reason for the request is to support some kind of welfare request, that her welfare amount can be raised under the hypothesis that she is responsible for more persons than just herself. As landlord, I am not involved in that procedure.

No additions or substractions of lease terms until rent is current. Make sure the actual tenant wants this person added to the lease. If they had a stroke, are they able to consent? If not, then you need to deal with the POA for the tenant. --174.105.xxx.xxx
