Regarding the rooming house: In the first 90 days of consecutive occupancy, I can legally do a self-help eviction. But, I still need to give 5 days notice where the roomer can pay with a late fee.

Rent is weekly, and first and last weeks' rent is paid at move-in.

So, when rent is not paid(on Friday), they have 5 days (most of the rental period) to pay up or move out (Wed).

What I'm thinking is to change the wording on the "Notice of unpaid rent" to say basically:

If you don't pay the rent and late fee in full by Wed, then it will be understood that you intend to have given your notice that you will be moving out by noon on Friday, and are using your last week's prepaid rent for this time period.

That way I wouldn't lock them out on Wed, but on Friday.

Do y'all think this would fly / make sense?

I know I can run it by my attorney, but at $75 for an email, I figured I'd run it by y'all first. : )

It may not be legal but if you word it properly,go over it at lease signing and explain this is the process and have them believing it you will most likely get away with it,people living in a rooming house don't have the resources to hire an attorney and not likely to be friends with an attorney or anyone else who would know any better --72.231.xxx.xxx

The way I do it now, I lose a week rent if they don't pay, then I give notice to vacate on Thu. Thinking of a more efficient, legal way to move out someone who has run out of money. --68.10.xxx.x

All my tenants can read, so I let them read the lease by themselves, but I do insist that they read it and ask about anything they don't understand.

In addition, I verbally repeat any of the main points: no adding roommates or animals without written permission, the carpet cleaning policy, anything else they will pretend that no one ever told them.

It appears to me that the lower the income, the more tenants are inclined to just sjgn, not understand, and then do whatever they want.

My higher income tenants all carefully read anything they are going to sign and they will ask questions about the terms. --174.216.x.xxx

DJ,

When we set an appointmemt and spent a few minutes reveiwing th highlights of the lease my life was instantly improved! We set expectations and people appreciate knowing. It’s on a recording amd goes quickly.

This also gets initials on each page and several highlights, which halts arguments and saves our rear in court.

People do not read the lease. Then LLs complain “Why won’t they obey the rules!?”

Me: ZT. Either they paid or not. Not=go. Not sure how this fits into rooming house law. I would not build in and teach them how to be late. I would move the date to say if not paid on time we consider that notice younwill be leaving.

I DO like your idea to spell out an automatic eviction/set out.
