We have family of 3 in a one bedroom in our 4 family house 600 w/ht htwt. plus parking. they have been there for 4 years, their father needs to move in which he did while I didn't notice. Now they do not want to ask their father for any rent since they do not think it is right. But anyway you may already have guest this year and this month they cannot pay the rent since one has had an operation and the other did not get paid for work that was done and no one has asked for the rent from Dad. Sooo am I to be hard hearted and ask for the Dad to be put on the Rental agreement or just give up one months rent. Just wanted to hear some feed back! --24.218.xxx.xxx

Giving up on the rent is never an option. Issue a notice to quit. The notice you give will be different if they are on a lease vs. month to month so make sure you Issue the correct one. You need to be able to prove they received it so either get them to sign an acknowledgement or have sherif deliver it. When you knock on the door with the notice to quit dad may open up his wallet. --24.147.xx.xxx

Boy, that's tough. It seens like this family is already struggling. Bringing in another family member would be nothing to them but disrespectful to you and the property. So i would give them notice to pay or quit. They will find a way, they are very resourceful and manage to live this way for this long. Take a step back and perhaps help them by providing a resource of a church or such that can help. Just give them the papers to be eligible. --99.203.xx.xxx

I concur with Johnny B time to serve a 14 day notice. You need to decide whether you are going to run a business or operate a charity.

While you're going thru this non payment eviction you should review the wording & all the clauses of your rental agreement.

FYI 4 people living in a 1 bedroom unit probably is in violation of the square foot requirements of the MA State Sanitation Code. you should have a copy of this code handy for future reference. --96.237.xx.xx

Your input means a lot to me but,

Being in business doesn't always have to be about business!

There has to be times of Donations and Gift giving especially to family who have been living here for a number of years.

I've talked it over with my husband and since its his nephew and Brother in law who had cancer of the colon, I'm heading towards a months free rent. But I may add the note about it being illegal to have 4 people in a 1 bedroom apt and ask them to put the father on the rental agreement since they refuse to ask him to pay rent.

Gee it's awfully nice of your nephew & son in law to be so generous with your money. Evidently you have decided to run a charity & not a business.

It's never a good idea to rent to friends or family. If things go bad like in your case, you (the rich money grubbing LL) are the bad guy for not helping them by forgiving their rent. the tenants will end up resenting you. The other family members who most likely won't offer to contribute a dime will also resent you.

If you really want to help them out you should give them some financial support to rent a place from someone else. --96.237.xx.xx

If I understand your post correctly you have been renting the apartment to them for a number of years at $600/month with heat and hot water included. If this is the case, you have already done more than enough to help them out. That is very low rent. What part of the state are you in? Considering it’s family I’d be even more upset that they were stiffing me on the rent. But as Steve[MA] said, it’s best not to rent to family or friends. --24.147.xx.xxx

Johnny Ma, Just to clarify, They are late and are having a difficult time right now. It was irritating about the Father in law being there without letting me know in advance but it was an emergency and they didn't know the extent of it. And I had come to understand that they did not ask the Father in law for any rent because of him being the granddad and no place to go.

The rental is in Norfolk county and average for the area.

I will have to talk with them all at the same time to let them know how I feel about the situation and ask the Granddad if he would consider pitching in for their rent, but as was mentioned already he is there illegally being that there is a limit on how many people can reside in an apartment per sq ft. --24.218.xxx.xxx
