I need to give my tenant (5 years) an eviction notice. We started the process to sell the home to him and now he has decided to continue shopping for another home to buy. We are fully in contract. They have not exhausted their inspection period yet and want to drag it out. I was in the process of 1031ing and have an offer in on another home. So, since he is not willing to make his mind up, I have decided to serve him a no fault eviction so that I may move forward with a my sale (I will loose my property in contract). Is there any specific wording or just "this is your 60 day notice of eviction. You must be out no later than XX date, I intend to sell the home"?

If he doesn't want to buy it, why most just leave him there and collect rent until he buys something? Seems a lot less messy. You're not guaranteed another buyer anytime soon. --50.32.xxx.xxx

Our market is very good for this type of home and price point. I am done with the home and want to move on. It will be good timing for me to list it in March- that is about the time would be able to if we give them a 60 day notice.

I just want to make sure I get proper verbiage and let them know if they want to move forward with the purchase, we are still willing to sell to them under the conditions specified.

You are not evicting him. You are giving him a notice to vacate. Big difference.

The way I'm reading your post, you have a sales contract with the tenant. If that is so, you are stuck until his inspection period is over. Unless he puts it in writing that he doesn't want to buy your house. --174.216.xx.xx

Ok, that makes sense. I will research notice to vacate. Yes, you are correct, we are stuck and he has made it perfectly clear he is not budging until he wants to (the period is over). Unfortunately we will most likely loose our other deal. --71.237.xxx.xx
