Tenant turning into a nightmare. Good tenants will soon be leaving if I don’t get rid of him. Bad tenant has a 1 year lease. Lease states that it can be terminated after the initial 6 months. Will that hold up in court or does a 1 year lease not get terminated for 1 year? Lawyer says try it and hope for the best. This is my one any only regrettable one year lease.

I doubt that you will have a judge say that a 12 month rental agreement with a provision for terminating after 6 months will be enforceable. If you do decide to try it, I suggest that you stay out of Housing court & use a district court.

What kind of problems are they causing? In order to give any meaningful advise we need some more info.

Have you given them a notice to cure any of the problems?

I have the Notice To Quit ready and I am on my way to Sheriff. I was hoping to just terminate without cause to get him out quicker. Police have already been there a few times ( I just found out about it yesterday.) because tenant has been screaming and disturbing the other tenants. He wasn’t screaming at them directly. Another tenant has somebody staying with her now because she is nervous to stay there alone. She says he is screaming about her. Police say they have been there twice to restore the peace. Good tenant says she did not call police and wants to call me to deal with him when he is mad. I told her to call police to deal with him. She isn’t the most honest tenant , but he does have a temper. --71.10.xxx.xxx
