State Specific Question About: CALIFORNIA (CA)

My next door neighbor's tree branches fall on our property,

I know I have the right to cut the branches that are on my property. The questions I have, do I have the right to place the cut branches back on his property due to the fact they refuse to share the cost of the labor and dump fees.

Do I have to give the next door neighbor an advance notice that the branches from his tree will be cut in advance? If yes, how many days?

You have the right to cut branches overhanging your property. As long as you are on your property, no notice to the neighbor is required. Unless you put the neighbor "on notice" that there are dead branches that need trimming in the opinion of a professional, your neighbor is not responsible for removal charges. --67.149.xxx.xx

You can cut branches from a neighbor's tree growing over the fence into your yard, but don't kill the tree, or you might end up in court.

I put the neighbors branches back onto their property as they told me I could. Then the police showed up at my house to arrest me. Neighbors claimed I cut their tree branches down to cause problems. The police were too dumb to notice the branches snapped off from 25 feet above and I'm not tall enough or strong enough to have caused the damages. I won in the end and since there neighbors were in their 80's, the law says they are allowed to make mistakes without any action taken by the City Attorney.

So in your case, it is a lot better to just cut the branches up. Put them in 40 pound or less piles, tied up and call the City for Bulky item free pick up. --47.156.xx.xx

You cut the branches, you dispose of the wood. You don't have to notify them to do something on your property. You are taking care of YOUR property.

We have cut stuff like that into about 16" lengths, then put them on Freecycle or Craigslist for free. Ad usually says that the wood is great for fire pits or chimineas. --71.175.xxx.xx
