State Specific Question About: MASSACHUSETTS (MA)

This is the situation, my tenant has a basement bathroom with a shower stall. the stall now has a drain problem and has standing water and the ten has asked me to deal with it. So I asker to put the usual stuff in baking soda and vinegar, she put it in but did not take out the standing water. Now a month has passed and I did not go there and she has mentioned the baking soda did not work, So how much did she put into the shower.one time she says and did not clear out the standing water. I say to her that 2 times a day would have been better. Now she says her toilet is a problem, so I ask, " you said the last time it was the shower stall" now she says her kids can not sleep down stairs because of the smell. I know I could have just gone there to clear up her messy shower but I wanted to see what would happen. --24.218.xxx.xxx

What has this to do with court for tenant? Well the tenant is on the second floor is going to court to try and appeal a restraining order from the tenant on the first floor. So I volunteered to go with her as moral support. But she spoke with the complainant and now the shower stall is an issue as she said" since you are going to court with her you should clean my toilet problem. I know I'm in deep here but I like the challenge that life brings and I'm partial to the underdog. --24.218.xxx.xxx

I would not recommend you go to court with one tenant as moral support against another tenant in the same building. As a professional landlord, you should not get involved in Tenant issues unless it affects your property. This will cause resentment with the "other" tenant. The only exception would be if you were a witness to an incident between the two which should not be considered moral support. --107.130.xxx.xxx

I tend to be the first responder. I would want to see what the blockage is.

Shower is normally an easy fix. As for the inability to flush, that would be a greater concern. If that came with time it may be unrelated.

These are easy calls.

Please get a plumber. It sounds like a clog in the line. I use Drano max but in this case if it didn't go down the tenant would be stepping in it and it can burn skin. Now that the toilet is also an issue and there is a smell it sounds more like a backup. You really need to get a plumber out there before the tenant stops paying and takes YOU to court for not providing basic services. --73.178.xxx.xx

The drain problem at the surface is your issue. Are you sure you want to go into a Court setting and be liable to answer questions on this sewer issue? That's not in YOUr interest.

Get it fixed TODAY and get a receipt that you can take with you to Court if you find a compelling reason to go.

"I gave my word"....come down with the stomach flue the morning of Court and do not go.

Patti -- is this for real-- baking soda--- never heard of that--- that gets like mud and cakes up-- your drain is now packed with baking soda??? USUAL STUFF? Use dawn and vinegar 50/50 or straight bleach. As pointed out though at this point get plumber with snake.

I am a California Licensed Plumbing Contractor, income property owner (over 100 units) and a property manager. When a tenant calls me about a blocked or slow running drain, it is my responsibility to talk care of the problem immediately. That day or the following day.

Not to ask the tenant to cast spells, pour chicken soup down the drain and hope it works or some other possible remedy.

I've had several tenants that kept on forgetting to alert me of a slow draining drain. Finally they got fed up and contacted the Housing Department. I was summoned to a hearing. I told the judge that the tenant never ever told me of his drain issues. Had he done so, I'm at that property every week and carry with me several snaking machines and store drain snakes in the buildings storage room. The Judge didn't listen. I then had to raise my voice and explain to the judge that I'm a licensed plumbing contractor with over $100,000 is specialized equipment to deal with drain and sewer lines. My tenant saw me several time and just forgot to tell me. My tenant had my cell phone number, my home number, my email address and he could have sent me a texted message 24 hours a day. How is this my fault?

I then showed the judge a paid invoice and cancelled check from the City of Los Angeles, who hired me to clear a city cafeteria main drain and a hospital drain line. If the City acknowledges me as a licensed plumber shouldn't my tenant also let me know of a problem before contacting Housing?

The judge issued me a fine anyways and then I put the city on notice that I'm going to sue the city. So the city refunded my fine payment. Crazy! --47.156.xx.xx

Robert thanks for that first sentence we've all been missing it.

I'm all in on the judges and their attitudes. Who do these folks think they are-- the innocent don't have a chance when the judge has already made up his mind-- even before you get inside the doors of the court. I would just love to go up to them and slap the you know what out of them. really.

My stories aren't exactly the same as yours but the types of attitudes from judges is EXACT-- and we're here in GA. They are schmucks.

One of my classics was a tenant called the gas company-- they said the furnace was safe but needed hard pipe not flex in a certain area. They locked it off. So I schedule to go over and fix. She won't let me in. She calls the county code people and I get a summons to appear. So I try to schedule again-- no go she won't let me in. I went to court- spent 6 hours to be heard-- DA-- when I told her "I wanted to fix but tenant wouldn't let me in" - said "that's your problem" and got fined 250.00. Next hearing was in 10 days-- if not fixed 500.00. Lucky for me she was evicted before the next 10 days. --99.103.xxx.xxx

Ok..... I didn't go to court this morning, talked with tenant and she understood. But as for the drain on the other tenant, well the plumber had to replace the sewer ejector and found not only panty liners a dozen or more but the empty bag they are sold in.It must have been from her 12 year old daughter,

Deduct the cost from the next rental payment [oh...make sure to get a letter from the plumber as to the cause and hopefully some photos of the debris] and then let them know that the RENT is short by that amount and when not paid start to evict. You are going to need an atty to get you thru this.

Oh my. Also, please make sure that your future lease contains a clause about not throwing anything down the toilet such as sanitary napkins of any thickness, including panty liners, etc. Please do include disposable wipes for babies or cleaning too. Please do a search on this site under "Wipes clog city" dated Oct 18, 2018 from Brad for an example.

I don't do 8 but surely there is some recourse? I think I would still bill her. Frank NJ makes sense on this.

We started last year with an addendum to all leases. "things put in toilet" addendum. With SFH's we have one up on multi's in that they can't blame people in apt # 2 or #3. --99.103.xxx.xxx

The property is 5 minutes from me and there are two buildings, the one with the sump pump is the issue and there is no one else involved.Since It is the basement bathroom there were no emergency as far as she was concerned. I have photos of the numerous panty liners plus the empty bag that was floating in the water when the technichtion opened up the cover. I'm of two minds in this.

One is that this was done deliberately by the Girl 13,14 years old or was done out of stupidity. the girls mother is the same person has taken the second floor person to court for harassment and has gotten a restraining order on her. --24.218.xxx.xxx

Robert J- Wow! interesting story..

Here’s mine... Had to go to court as the tenant sued for security deposit.

(Wanting 3x $1200). And said they had to move since the basement flooded with sewage. I took immediate action when they called me with the problem. The sewage did back up into a portion of the cement floor laundry room, but did not flood the entire basement. I had the plumber put a camera down the line to see if it was roots or their debri. What did we see? Baby wipes! We took the video footage with us to court, also I took a pic of the downstairs bathroom and noticed later as I prepared for court that on the tp holder, instead of toilet paper, there was a large roll of kitchen paper towels! Took that pic to court along with the video.

The judge gave them $200 of their deposit back. The tenant was SOO mad! She was expecting triple damages. I wasn’t thrilled with having to give back some of the deposit, (I feel the judge did it to appease all).

Interestingly, the next tenant was my daughter who happened to move into that house with friends and one night the old tenant shows up to “bad mouth” me & scare the new tenants! She even tried to walk into the house, and my daughter, knowing the whole story, told her she was going to call the police and slammed the door in her face. --75.70.xx.xxx

You asked where is the property, Norfolk/Plymouth County line. this tenant came in from Quincy. I really feel like she is resentful of the woman on the second floor. I really want her to move on but I do not know what kind of reason I can give besides having my family members coming in. That last Sandy is when you see the Judge seeing the whole story. Good for you. Some people think they can have it their way when they cause problems with the landlord. --24.218.xxx.xxx
