State Specific Question About: CALIFORNIA (CA)

A tenant bought a new truck. About 1/3 of truck bed stick out of carport and blocking 1/4 of driveway width. This carport space is only 3 parking spaces away from the entrance automatic gate, and many tenants complaint. It also caused the opposite side parked cars can't back out easily.

Manger said the towing company can't tow the car because tenant is parked at his assigned space.

Tenant refused to move the truck. What should I do?

Letter to Tenant, "The way you park your truck blocks the driveway. This interferes with the other tenants' ability to use their parking spaces, and creates a danger in the event of an emergency. Cease and desist in blocking the driveway. This letter shall serve as a __ Day Notice to Cure."

Besides giving the tenant the letter as per Mike NV, I would issue the tenant a "3 Day Notice to Cure Violation or Move Out".

Then after the 3 days have passed, I'd give it a week, I let the tenant know that you have three options:

a) have the vehicle towed at the tenants expense

b) Evict the tenant

c) Tow the vehicle and evict the tenant.

I've had this problem and for 3 months my tenant would park an extra car in a fire zone. I was cited by the fire department and blamed by Housing for harassing my tenant. So I first towed the car. Then the tenant got free legal aid and came after me. Then I filed for eviction. Won both cases. My tenant under rent control was only paying $550 a month for a 2 bedroom unit and the market rent was $1,100.... --47.156.xx.xx

Just give tenant a notice. Tenant refused right at manager's face. It's the extended cab truck. The type of long bed truck that I often saw at Home Depot parking lot that takes two parking spaces.

The property parking lot driveway is a L shape with automatic gate on each end. All carport spaces are the same. --76.169.xxx.xxx

I think this is a tenant writing because she is having a problem parking She mentioned that management is not doing anything. I would get together with the other tenants and go to management together. They might just ignore you. They should have put something in the lease about vehicle size and parking and have this guy park on the street. As a tenant there is nothing you can do except go in a group to management and if the situation is bad enough and you can't park on the street, then find another apartment. --73.178.xxx.xx

He's parking in an assigned parking spot. Why should he move? Unless he's purposely not pulling all the way into his spot or something like that I have a hard time seeing how you could require him to do anything different. He's parking exactly where you told him to park - how can you tell him to cease and desist parking there? Provide him a financial incentive to switch parking spots with someone else where his truck fits better - maybe he'll agree. Going forward, add something to your lease allowing you to reassign parking spots based on size of vehicle. Or if you don't have parking spots big enough for a truck, require all of your tenants to drive compacts. --12.156.xx.x

He's not parking in his assigned parking spot if the bed is extending out into the driveway. He's parking PARTIALLY in his spot and partially on the driveway. If you don't have another space for him to park in, post a notice to cure. --204.210.xxx.xxx

My experience is that most people are visual learners when it comes to parking. So you need to give them visual parking aid ( they don’t see see signs or even letters you mail to them). They need things like strategically placed massive rocks or cement barriers. --174.199.xx.xx

Tim, he is parking in his space, but he is also parking in the driveway. The part of the truck parked in the space is fine., The part of the truck parked in the driveway is not fine.

When I rent a unit, and the T owns large furniture that does not fit, that is the T's problem, not mine. When I rent a parking space that fits a 20 foot car, and the T has a 24 foot long truck, that is not my problem.
