Generally the costs of evicting a tenant are recoverable if your state allows it, if you in court and if it's in your lease.

I am a licensed California contractor. In my contracts, the my clients sign, it has a provision on disputes. Any dispute has to be put in writing and given or mailed to me with a "proof of service/mailing".

If the client and I can't resolve issues, it has to go to arbitration. If I refuse to mediate, then the client can sue me.

I had a couple of clients over my 35 years of contracting sue me without giving me a change to make good on a problem. The only issue was, the client had several contractors over the years and mixed up who did what to their property. They were blaming me for work that I had nothing to do with. My contracts with copies of their payment checked proved as much.

The amount a client can win with respect to cost are limited in my contract. --47.156.xx.xx

Gotta know YOUR judge. Every judge is different.

BUT...

in court you always want to start high, include every expense you can think of. The judge will knock out what he/she won't allow with no harm to you.

We charge $35 to deliver written late notices. If it goes to court my judge will not include it because we are not attys.

So...we make certain our allowable repair and cleaning costs are high enough to cover our time.

If you win, the court can decide to add those expenses to the prevailing (winning) party.
