SS Number problem (by Oregon Woodsmoke [ID]) Posted on: Nov 11, 2018 5:58 PM

My mother left her estate in trust with my sister as trustee. The work is being done by my sister's boyfriend. The boyfriend wants my SS number in order to close out the estate.

the problem is that he has a reputation as a conman and my sister simply does not understand the concept of "not yours". They already know my name, birthdate, mother's maiden name, and one of my checking account numbers. I'm not wanting them to get my social security number.

There is a chunk of money coming my way and some real estate being sold, so I suspect that Uncle Sam probably wants my SS #

Any suggestions would be welcome. --174.216.x.xxx

Have him deposit the funds, no ss number needed - hire a better trustee. --76.188.xxx.xx

You need to put a lock on your credit reports so that he can't apply for credit in your name. Then also make sure your bank accounts are locked so that information can't be accessed with the last 4 digits of our social security number, change it to a pin number.

You should check to see who is the real executor and trustee of your mom's estate. Don't take their word for it. You should ask for a copy of the Trust AND Will. Ask for your mom's attorney who drew up the trust and accountant and confirm things.

Giving your social security number is a necessary procedure to complete the paper work for State and Federal purposes. Good luck. --47.156.xx.xx

Your sisters boyfriend should not be involved in this. Your sister is trustee, if she is not doing the job, you need to get someone else appointed that is trustworthy. Is there a backup, contingent trustee listed? Talk to the lawyer that set up the trust.

Since October, a consumer can easily put a credit freeze on their accounts with the big three credit bureaus. You do it on-line and it is in place within 24 hours. --98.146.xxx.xxx

Did you receive notification from Trustee of the estate and an opportunity to request the accounting and copy of trust and accouting of money? You should have gotten that letter. --99.203.xx.xx

Can't hire a trustee. His mother named her. If she resigns a lawyer can be a trustee but it's hard to get them to sign checks for work on properties. If you don't trust her then get a lawyer for yourself just to make sure you get the right numbers after everything is handled. They probably do need your SS but have your lawyer know about it. Most lawyers do not understand trust law but at least you would have someone used to reading legal documents. --73.178.xxx.xx

When a person dies, a final tax return must be filed. This takes care of the income up to date of death.

Then the assets go into a trust or are probated. The money that is earned between the date of death and when the estate is settled must be reported by the beneficiaries. This is done on the form 1041. This form includes forms K-1 splitting up the income by the terms of the trust or will. The form K-1 needs your Social Security number on it or the trustee is required to withhold 30% withholding and cannot file electronically. You need to give him your SS#. --173.15.xx.xxx

Credit freezes/thaws are free, as of 9/21. If there's no way around it, do the freezes. Quick and simple - but be sure to put you PIN in a safe place for when you need to thaw with a bureau when you apply for new credit. --71.175.xxx.x

If she is doing the paperwork herself instead of using accountants and lawyers, do some research and then meet your sister and do the paperwork together. Or discuss paying professionals to take care of it instead of the boyfriend. Trusts and money after death can cause families to rip apart, talk with your sister and offer to help. Being left in the position of trustee is not always easy. --24.61.xxx.xx

Here's what I did: my sister is borrowing money to cash me out of my mother's house, so there is an escrow involved. I've arranged for the escrow agent to put my SS# onto the prepared tax forms and to mail them directly, without my sister or her boyfriend seeing the number.

It's now up to the boyfriend to get the tax forms done and into escrow, which is supposed to close today.

I've put security alerts on my credit, notified my credit cards to be extra careful ( one of them gave me a password)

As soon as money is wired into my account, I immediately move it to a different account, then I go into the bank, get a cashiers check and move the money to a different account.

Nothing like an estate to make people act crazy. And, of course, the person writing the will always assumes, wrongly, that the heirs will be reasonable and follow their wishes. --174.216.x.x
