I won a judgment in Indiana. This is The only eviction I’ve had to do in 14 years. It looks like the next hurdle is collecting it. We got a garnishment for the lady but the next day she quit her job. The man works at a new job and I’m trying to figure out how to find out where he works. Any advice would be greatly appreciated. --75.146.xxx.xxx

I've only had to do wage ggarnishment twice in my 20 years and this was the hardest part.

It's illegal for you to follow the person from home to their job, but it's not for a private investigator. So you could check into that. You could then sue for the cost of hiring the PI and then add that to the wage garnishment.

You could wait 90 days and do a credit check if they agreed in the lease (like mine) to approve a credit check if they owe you money.

Jeff,

Indiana Small Claims system:

File an MPS (Motion for Proceedings Supplemental) with the court at no cost. This "hauls them in" to court to tell the judge their new jobs. You'll need a current address to serve them.

If you can locate their work simply send a letter to the court notifying the court of their new employment. No MPS needed.

Start with their original application for clues - retrace the app - did they live with parents as a former LL? Emergency Contacts, neighbors at the rental house who might know stuff, old work buddies or boss,

Facebook can be golden.

If your app has the proper wording ("at any time") you can pull a credit report.

Current residents and every new lease - My lease is clear: Requires 4 Emergency Contacts per adult. Res signs authorizing deliveries and notices to these trusted persons. (I can serve their Granny!)

Not that I would ever do this but where does it say you can't follow someone? Not that I would do that but are u making this up or do you have the statute for the code?

Garnishment is not only for evictions. For 14 years only 1 person has owed you money. Even if you only had one place 1 is like impossible.....

I'm not trying to be a smart *** here but how do you all make money in this business? I've got at least 30 garnishments going and many waiting in the wings. People here don't pay per the contract and they certainly don't return the homes in conditions even close to the way they receive them-- minus the normal wear and tear.... do you not go after these destroyers of property?

I really mean this question. I would love to really really see how your all getting these property's back because I can't believe people who rent in KY or MO or IL are much different then here in GA. AL or LA or NY. I've been reading here for years and know the damages you speak of. --99.103.xxx.xxx

Jeff,

A reminder: Indiana law allows 8% interest on the ORIGINAL amount until fully paid. I use this to encourage folks to get the judgment paid off as soon as possible.

We find most people are cooperative when treated with respect.

They also learn we are not going away and bring them back in if they stop paying.

My encouragement is to STAY ON THIS because people go on disability (can't garnish), they get sick, injured in car accidents, die of old age or overdose... We lost 3 this year to death. Goodbye judgment.

MYOB I know you don't believe me but we *do* get 99.9% of our properties back undamaged, clean and with no rent due.

It's all in the up-front screening. 99.9% of the people who inquire don't get past that first inquiry. Better empty houses than the wrong tenants.

That said, we are in an area where even semi-affordable housing is in huge demand. I'm not kidding myself. If I were in GA, I might have to compromise on tenant quality more. --50.82.xxx.xx

WMH I wouldn't have believed it. I'll venture that we are opposite in numbers-- I get 1 back in a year out of 63 ready to go the other 62 have rents and damages galore.

As example: last month tenant calls me on 10th-- after leaving 30th. Lease was up. She was sent COP the condition of premises and her original inspection to use on getting it ready for turn over.

Her bill was 1800.00. So she's gone--- gets the bill-- and calls the 10th -- wants to see if she can do the items on the list? 10 days after leaving.

She had the list of items needing work but ignored it until she saw the bill. We send the MC&F's with inspection. Minimum charges and fees-- the amount she will be charged for not returning the home to us properly. Again ignored until she sees the total. This is typical-- 1 to 5K depending on how piggy they are.

full houses with tenants who love their job and would never quit cause they wouldn't be able to find another one like it. Keeps our garnishment account flowing with income. --99.103.xxx.xxx

myob - in Pennsylvania, wage garnishment can only be used for back income taxes, child support and landlord tenant judgments.

When we go for our hearing, if the tenant is still there, we cannot ask for damages. After they are out, we must file a civil complaint.... that judgment is not garnishible. --72.70.xxx.xxx

Nicole, as far as you know, has PA changed the garnishment law so we can now collect on back rent as well as physical damages? My understanding was that it used to be only physical damages, which as you noted, is basically impossible since we don’t know the extent of damages while the tenant is still residing there. Then I thought I heard it just recently changed to also include back rent. I’ve garnished before for back rent, but I went before a 110 yr old senior judge who I really don’t think knew the exact law. I got away with it, but I think I was lucky. --174.201.x.xx

yes, you can collect on back rent HOWEVER, and I think I am right but would certainly double and probably triple check prior to spending any money - the tenant must either be personally served or show up in court. Constables here don't personally serve ... even if the tenant is standing in the doorway ... they post the property so it's not necessary to worry or care about who does or doesn't live there. --72.70.xxx.xxx
