If this tenant vacates after notice but before the eviction is heard in court, does the eviction hearing still proceed if he still owes back rent but is not living there?

If they still owe money, you'll want the eviction to still go through, you already paid for it didn't you? Besides, you'll want judgment entered so you can go after them to collect it. Yeah they did the right thing by finally getting out, but they should also pay what they owe. --184.102.xxx.xxx |

You want to proceed because legally they can decide to move back in. Until the judge says, "Your tenancy is terminated!" the tenant has legal possession of the premises.
On the day of court, the judge will ask if there is anyone still living in the home. If "no", you don't file to execute the eviction. If "yes", you do file to execute the eviction. --173.20.xxx.xxx |

It depends on your state's laws.
In my states, if possession is no longer in issue, then the expedited processes for summary eviction are no longer necessary, and the eviction case is bumped off the fast track.
Of course, the T might have moved out secretly and I don't know that possession is no longer an issue. That has happened a couple of times, and we kept on the fast track, thinking that possession was in issue.
