State Specific Question About: RHODE ISLAND (RI)

Good Evening, Everyone. Tenant has unauthorized vehicle on premises. I sent notice (regular mail with proof of mailing) to Tenant and the owner of the vehicle that it will be towed if not removed by a certain date. Here is my question. Do I call a tow company or the police? Thanks in advance. --100.40.xx.xx

I would think that in RI the authorities would fine the owner for no plates and publicly visible. Maybe they don't know yet...

As to towing, get a sign up NOW that says you will tow unauthorized vehicles.

Then call the police and ask if they have an impound lot for vehicles without license plates.

If the police don't impound, ask them if it is legal for YOU to impound. If so (and with the sign and notice it is) call a tow company. They will charge a daily rate for storage plus the tow fee for the guy to get it back.

No parking lot, private residence

Not really visible from road, 150+' from road.

No signage

I would think a notice to cease and threat of eviction but if it's not doing anything and can't be seen from the road then why make trouble? I just had to make a tenant take two torn apart and stinky motorcycles and five gas cans out of the attached garage that is a common area but that was a danger. I have called the police when a guy tried to leave a car in his sister's driveway with no plates on it. They gave her a notice and said they would have it towed if it was not gone in two days. It was right by the road and I was complaining since there was only parking for two cars for each unit of the duplex. --73.178.xxx.xx

Many municipalities base their authority to tow on a sign threatening towing and impounding of the vehicle pending payment of expense, but it needs to be backed up by an ordinance authorizing such treatment. What does YOUR lease (ordinance) say?

Because I have no way of knowing who's vehicle is parked on the property, I have professional signs posted at each entrance and exit of my property. It has the name of the towing company and their number and the police also.

When a unauthorized vehicle is first on the property I put a notice on the windshield and take a picture. Then I call my contracted towing company. They show up, let the police know it's being towed and then they tow it away to an impound yard.

If the person want's their car back, it's going to cost them $125 for the tow plus $25 per day. --47.156.xx.xx

Call a local towing co. and ask them the process for towing an abandoned vehicle from private property. I recently had the same situation as you, departed tenant left behind a junk car. They would not respond to my texts or calls. Called a local tow co. and they had a tow truck out that afternoon. Operator had me sign a very simple form (1/4 sheet), minimal info, stating the vehicle was abandoned. He took it away!

The tow co. makes their money on this by either: 1. Collecting tow/impound/storage fees from the registered owner or: 2. Car goes to auction and tow co. gets the proceeds. --71.212.xxx.xxx

2 years ago I had an evicted tenant leave a non-running vehicle in the driveway resting on concrete blocks. My Writ of Possession was all that it took for a tow company to come and pick-up the car. --68.63.xxx.xxx
